So I have finally finished building the following website, please let me know your thoughts, what's missing, what you like and don't like...

    The site looks amazing, but do you have permission to use the trademarked word 'Disney' in your domain name? If not, I think it's probably only a matter of time before you get a letter from their attorneys.

      Thanks Dave, glad you like the website.

      Unfortunately I do not, it is a worry of mine, however I am risking it. The way I see it is that I am representing Disney as a retailer, so why can't I use their TM when selling their products. If I do get a letter from their attorney then I will discuss the situation, if there is no flexibility I will obviously have to take it down.

      For now, it's live and I am sure I have a experience ahead of me.

    Does look good, but yeah, Disney is notorious for how ruthlessly they protect their own trademarks -- no chance this one is going to escape notice and absolutely no defense that you can legitimately mount against them.... Sorry!

    (My primary client in my software consultancy is an attorney that specializes in Patents, Trademarks, and Copyrights, as well as continuing legal education -- Disney is THE example he uses in his courses and with clients as the company to NEVER infringe upon).

    I had a website that sold NASCAR collectibles that had the word NASCAR in its name. After two years of selling their licensed products from NASCAR-approved manufacturers, I was contacted by a wet behind the ears attorney representing NASCAR and told that not only could I not have the word NASCAR in my name, but that I could not even mention the word NASCAR anywhere on the website. I asked the attorney what I was supposed to call a Dale Earnhardt collectible car - an Indy car? He didn't care. In the end, I shut the site down, telling the idiot that they just lost another merchandising route.

      Why don't you just choose another domain name and rebrand the website accordingly? Disney won't stop you from selling their products, they'll only stop you from using their name in your branding... The site looks good and it would be a shame to see it go to waste.

      You could, but I think there's about a 99.99% chance they will just tell you to drop the domain name. I would find another targeted domain name that doesn't have the word Disney in it & brand that instead.

    Yeah I don't think you are going to be able to use that domain for a long time, contacting them most likely is going to result in them shutting you down now instead of later. If you are willing to risk the most likely scenario of losing the domain (and your brand identity you may have built) at some point you can press ahead and try to stay under the radar.

    I would suggest getting something different and building an identity around that instead. If you go this route you may as well contact Disney and at least see what they have to say first.

    Yeah, you're definitely going to get into trouble for this... I'd recommend a separate identity, too. They're definitely going to pull it down, no question. Enjoy the ride, I guess. They'll certainly sue you for infringement. I hope it doesn't end too ugly for you.

    I absolutely love the site design, graphics and product pages. Perfect for your niche.

    However, you need to change the domain - sooner the better. Just transfer you content over to a new domain. No use marketing a site that you'll definitely have to change later.

    Listen, ditch the trademarks and ditch them now. Here's why:

    Having pursued someone for intellectual property infringement before, the MO of IP attorneys is to allow you to accrue revenue and THEN pursue you. Infringement allows the trademark owner to collect actual damages AND punitive damages. Allowing you to generate revenue = more damages for the owner of the trademark.

    Don't risk it, or else you could get hit for a lot more money than you think.

    Yup, quite pleasing to the eyes indeed. I do note that almost everybody who complimented you on how nice the site looks have concerns about the domain name. You might want to spare yourself the aggravation later on when (not if) Disney's hounds come a-knocking. Better us to tell you than them, right?

      I'm not going to give you legal advice.

      Your products need to be pushed up the page, and I would put that Youtube video on the right hand side, small, on autoplay. You have 2 seconds for people to identify that your website is an eCommerce website, so you have to show them products as soon as possible and in my professional opinion, it's best to put your best selling and/or hot items up towards the top so it's one of the first things potential customers see.

      Pre-orders and "Limited Quantities" go hand in hand. You'll increase your conversion rates by showing low quantities available. I do this as a HotToys sellers.

      As a point of reference, you can tell a cease and desist is getting serious when a signature is required or better yet, when you receive a court date

      There are clever ways to market this without outright using the Disney name. Regardless, the site looks great and I wish you success!
