You Cannot Unsubscribe From Our Mailer According To Our Terms. WHAT?

When I first started out way back in '07 , I messed around with safelists and traffic exchanges to get some traffic, mainly because I just didn't know any better.

Anyhow, I was also dumb enough to use my main Gmail email address as the one I signed up to all of them with (probably about 50 total). I think you can probably guess how full my inbox would get every day with junk and spam. That's why when Gmail introduced the tabs feature, I wasn't that upset, even though lots of marketers didn't like the idea of a "promotions" tab separate from the "primary" inbox.

Over time I've managed to close all of my accounts and unsubscribe from all of them. Well, that is, all but one. No matter what I do or how many times I close my account, I still receive emails. They have an "unsubscribe" link, but when you click it, you are brought to a blank page with nothing but this on it:



Now, correct me if I'm wrong, but doesn't the CAN-SPAM Act require that you honor unsubscribe requests within 30 days of receipt?

My only recourse is to hit the "spam" button. I hate to do that to anyone, being a marketer myself, but what other choice do I have? Even though I hit the "spam" button, one will still slip through every now and then. I've put in support requests to no avail. They always get returned to me with that "failed to send" notice.

I'm surprised they can still send emails with the amount of spam complaints they must get. They must have their own dedicated server or something.

I crossed out the name because I'm not one to do the "name and shame" game.

What are your thoughts on this? Maybe some Warriors who know more about email marketing than I do can chime in?

    I would have no problem reporting that as spam. And I'm pretty "spam" tolerant too.

      What terms? lol, I'd like to see these terms.

      I'd just report as spam.

      What good is that unsubscribe link if it doesn't work?

        If they have some kind of consistent 'signature', a characteristic that only the bothersome emails have, just set up a filter to delete them on receipt. You'll never even see them.

        Or set the filter to forward the emails to Google's abuse or fraud emails (abuse@gmail.com, I believe, not sure).

          Luckily the emails usually go right to spam anyway, but like I said once in a while one will end up in my inbox.

          Good idea, though. This is probably the best way to deal with it.

          It just blows me away that somebody would openly tell you that you cannot unsubscribe. I guess when I signed up I probably checked a box somewhere and agreed to these "terms."

          Still, though, I don't think you can set terms that are against the law.

            HOW TO REALLY REPORT SPAM AND CAUSE A MESS FOR THE SENDER

            Okay guys, you just hit my field of expertise (fraud prevention, ret.). You run into this sort of thing a lot in the scam world, especially when clicking on unsubscribe actually adds you to a list of "active" email recipients which is then sold at a premium. It's an additional income stream for a scam niche that specializes in id theft, among other things.

            Down to business.

            1. sob@ icanscam.com < the only part you want is the URL after the @
            2. Go to http://whois.domaintools.com <that specific place for the info you need
            3. Paste icanscam.com into the site's search window & tell the captcha that you're not a robot.
            4. This will give you the registration information which supplies the name of the host server on which the domain is located, along with the email contact addy for the host (GoDaddy, Hostgator, some web host you never heard of). Copy and paste the addy in word or notepad or sticky note. However you take notes. DO NOT USE THE CONTACT EMAIL FOR THE SITE OWNER.
            6. Go the the page where the 'can't usubscribe' is located. Copy the URL and paste it on your notepad.
            5. With that email address and URL in hand, return to the email that will not unsubscribe. Click on Forward.
            6. Paste in the host's email address in Send to
            7. Subject: YOU ARE HOSTING AN ILLEGAL ACTIVITY
            8. Message: Landing page for usubscribe link in the email below: (the web page URL)
            .....................Email I want to stop receiving below. The sender refuses the unsubscribe request.
            9. Hit send and forget it. You may or may not receive a reply from the web host. Usually, the bad guy activity is killed within 24 to 48 hours unless the damn critter is being hosted on a private server somewhere in Asia or Russia.

              Wow that's pretty awesome. I would have never figured out how to do that. Much appreciated.

              Honestly, though, I'm not out to try and wreck anybody's business. I simply want to unsubscribe and not receive email from this person anymore, which is my right. I am an email marketer myself, and I know I wouldn't dare pull a stunt like this.

              I'm sure I'm not the only person who is pissed off about it. I guess they figure most people will just close the window and accept it, but I'm pretty sick of it. People that do this crap make it harder on all of us who are doing the right thing with our lists.
