"Contact Us" form submissions, can I email them to get CASL consent?

Hey guys,

Can I send a mass email today (May 31, 2016) to the "leads" that filled out a contact form after June 1, 2014 on the website .... and ask for consent?

Something along the lines of "Hey, you gave us your email address at some point in the past couple years but now I need you to give me permission to email you"

Please help!
Thanks

Sending an email to see if you can send emails?

Doesn't the time they filled the form count as consent?

On the websites that I create, I make sure the privacy policy states that the emails they submit are fair game for email blasts. They have to agree to the terms of service and privacy policy before they submit any forms.

Canadian laws are different. You can't do it that way in Canada.

Non you can't unless you have express consent when they submitted the form.

"Express consent means that a person has clearly agreed (orally or in writing) to receive a commercial electronic message. It is not time-limited, unless the recipient withdraws his or her consent.

Usually express consent is implemented in the form of a checkbox that is not pre checked on a form.

      Thanks for your reply!
So yeah, after June 1, 2014... they submitted a "Contact us" form that did not have any consent box for them. Which is why I wanted to know if I'm still in the time period to just mass email them and ask for real/express consent.
