How to start building an email list?

I have a website where users should take some action and convert, that action involves a modal window that is being opened.

From those users, I now want also to collect their emails. I was thinking to simply place some form at the bottom of that modal window, calling them to subscribe to the newsletter.

But I don't know how to do it technically. I can hire a freelancer, but not sure how to ask him to do this. Should it be simply a form? what happes once user submits the form, where will the data with all email will be stored, and in what format? simply some text file? or CSV? or database?

What other info should I collect? perhaps the page that user originally came from (as my modal window appears in various pages of in my website)

I guess I need something enough advanced so I can distinguish between users who visited different pages, and also a way to easily grab all those email and send them the newsletter.

Should I send them a subscription confirmation? With what kind of tool should I send the newsletter? How do I know it wouldn't go to their spam folder?

Is there some service that handles all of these altogether?
