Can i sell binary options and some forex leads?

This forum's a bad place to ask for and/or to take legal advice.

I'm not qualified to offer any, but my own impression is that it isn't selling them that's illegal, per se: it's the buyer using them which won't be Can-Spam compliant (and will have other problems).

But it certainly isn't ethical to sell them, if people haven't consented to your doing that (which, of course, they haven't, as you describe the source of the "list").

They also probably don't have very much value to anyone else, really.

They might, to you, if you use them for email marketing, because they've already done something through your site, and you can mention that to them? However, I'm not even sure how legal it would be for you to contact them, yourself, given how you came by them. (And - just as important - whether it would be within the terms of service of whatever service you'd use to contact them, including your own ISP and so on!).

Here's the thing: this issue presents itself to you as a "conundrum" because you have something of some potential there and you're not using it, but the main reason you're not doing so is that you're not actively listbuilding, yourself, from your own site, in the first place? If you put that right, you'll have a list of far greater value, and you'll perfectly legitimately be able to use it, yourself. That's the real answer, here.

I hear you; but the honest answer to that is "That's why you have the 'problem' ".

Of course, it isn't really a "problem": it's an "opportunity".

And as is so often the case, the profitable way to use the opportunity is to acquire new skills: you should really be learning how to do that, and build your own list for your own use. (If I were in the binary options and/or forex niche, the primary purpose of my affiliate website, to which I attract the traffic, would be to build my own list, because that's where most of the money is, in those niches. I'm not in those niches, as a marketer, but I'm also a forex trader myself, so I do "know the niche", at least to some extent).
