Suggestions about Affiliate Terms and Conditions

Hi,

I have some questions about what to include in an affiliate T&C. I know these questions may contain legal issues probably best discussed with an attorney but before I do that, I'd appreciate knowing any issues or ideas you have about the following:

Are there problems with allowing non US affiliates, so long as PayPal will pay in the affiliate's country?

Are there problems with affiliates buying products from a site where they are affiliates? So long as the purchases are not for resale?

Does allowing affiliates to issue press releases about becoming your site affiliate likely to cause problems?

If you have an affiliate program, is there anything you wished you had added to the T&C when you first wrote it?

      Anything you don't want an affiliate doing you should include, such as

      - Unsolicited email, fax, and 'Do Not Call' compliance

      - Making false claims about your product

      - Putting your product in a disparaging context, such as "OMG! Is Product a Scam???"

      - Not claiming they work for you or are acting your behalf.

      - Do you allow them to copy your sales page and pictures?

      If it's an IM product I'd reserve my rights to delay payment until any refund or fraud period has expired. Sometimes you get the middle of the night sale from an affiliate with a China IP address who sends one click, they happen to make a sale, and the buyer has an IP address in Nigeria. Could be legit. Or, sometimes you learn from experience certain countries are hotbeds for fraud and you're asking to be scammed unless you protect yourself.

    IMO your best bet is to contact your AMs at the companies you deal with to confirm. I am from outside the U.S. and have never had issues with what you have listed

    You should take a look at more famous affiliate TOS to get an idea of what you need to include in your own TOS.
