legal disclaimer for a forex product

Hi Warriors,

Does anyone has some experience in selling FOREX oriented products.
I have developed a product by my own and need some legal advice regarding risk disclaimer.

Any kind of advice is welcome,

    Since it is your product and your risk you should really consult an attorney for advice.

    You could look at other similar Forex products to see what kind of disclaimers they use.

    But without a legal expert looking at them you wouldn't be sure the other product is properly protected.

    You may also find some guidance on the platform you want to sell through. Many digital product platforms are wary of Forex products due to past scams and problems. Those that accept them often have stringent requirements for disclaimers.

      Thanks you for advice onSubie, however my biggest problem is that I'm not able to find a forex oriented lawyer. Every single lawyer which I have contacted doesn't have a clue what I'm talking about So I was hoping, I could find here someone with some experience on this matter.

    You need a short one that appears on all your stuff (videos etc and footer of all webpages) then a long one going into details.

    We have consulted with lawyers but I have been in the FX industry 7 yrs and know our laws inside out, this is adequate.

    Have you looked at forex products similar to yours? You can get some inspiration there, don't need to pay attorney.
    Search fro some forex robots, trading signals, training courses... you'll find plenty of stuff.

      Thanks guys, this is great info!

      So far I came with the following short disclaimer:

      In the footer area of my website:
      "This website contains valuable and informative high quality material, that can be used for any kind of currency trading. The presented information is meant for non-commercial, informational and personal purposes only, and all of freely downloadable materials are meant for non-commercial home use only. "

      In the manual:
      "To the maximum extent permitted by applicable law, in no event shall xxxx.com, or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business time, business profits, business information, or any other kind of loss) arising out of the use of, or inability to use the software developed by xxxx.com, or the failure to provide support services, even if software, or one of its supplies has been advised of the possibility of such damages."
      + the well known "CFTC RULE 4.41" statement.

      I would be glad to hear your opinion.

    1. Don't listen to anyone that tells you to copy another website's "risk disclaimer" especially for something like a Forex product. Uneducated website owners are copying or barely editing disclaimers that have been around since the 1970's and that are virtually worthless.

    2. Be aware that a "risk disclaimer" is a very limited legal statement. Even with a well worded disclaimer you can still be sued and lose. You can still spend huge amounts of money defending yourself.

    3. Many attorneys that even specialize in Internet legalities may not want to touch anything associated with a Forex "product" or "software" since they have a legitimately bad reputation for being scammy GRQ schemes. (No offense to anyone that promotes the rare exception that might exist.)

      Thank you for great tips. I know what I need to do, but the hard part is to find a lawyer who knows the FOREX legalization rules...so far I still could not find any decent FX lawyer.
