How do big blogs get away with copyright infringement?

The title may be a little off, because there is no way anybody can get away with copyright infringement (this easily)

I was wondering how big news sites like ViralNova, and Funny or Die copy information from other articles, and don't have any problems. They do list their sources in their articles, however I had viewed the terms of use from the sources they use, and they all state that their content may only be used for personal, non-commercial use, though the use is definitely not personal, and it does not happen to be non-commercial.

Unless I am completely wrong, and stating your source dismisses you from following the terms of use, or these sites have special access that I am unaware of, can somebody please explain why this is acceptable?

    How does Google do it even? There has to be a way to report infringement followed by removal of the material once the report is made. Take a read on DMCA and safe harbor provisions.

    I have a news site and we get the images via press releases... most have fair use age with them....

    I had a film site for a while and this was the same

      The DMCA doesn't state anywhere that citing your source omits you from abiding by the terms of use within a site, that defines that their content cannot be used publicly or commercially, however some media websites that cite their source DO use the content publicly and commercially.

        It's called "fair use," which has been permitted by the Supreme Court. You're allowed to quote a portion of the article for the purposes of review, criticism, or satire/parody. I don't know about Viralnova but Funny or Die is obviously covered under parody. You can read more about this legal concept here: Fair use - Wikipedia, the free encyclopedia.

    I hope your not thinking of doing the same...getting away with it?

    I think Google favortizes big sites and likes to let things slide a little because big sites offer Google more ways to help them make money.

      No google don't favouritize big blogs but the big sites follow some basic tips or tricks which is missed by new person.

      Before start any work, you must have research and plan. If you have that, then its well and good. Just go for it.

      I didn't know Google dealt with copyright infringement.

        These are aggregator sites and you can't apply "infringement" to them without knowing why kind of aggregator they are and whether it's permitted or not.

        There are paid content distribution networks, permission based networks for content, curation, feeds....chances are if you look at a high visitor/high income blog, they aren't simply "stealing" content daily.

          The guy who runs ViperChill once had a Twitter exchange with ViralNova founder Scott DeLong asking about what would happen if ViralNova suddenly got a bunch of DMCA notices. DeLong replied that "we work with most of the photographers/sites at this point, so that wouldn't and couldn't happen."

    I have seen instances where this "fair use" deal went into play. But I have also seen some big sites copy articles word for word (posing as the authors) and Google showing the site with more link 'authority' in searches.

      Ya sometime Google need to worry about these things that if you have good authority links then it will create confusion in google algorithm as well.

      If you have good authority links, it also increase other factor of SEO like trust factor, User Signals of website which helps you to save you from copyright.

      I used to have a printable coloring pages site for kids and that happened to me with many of the images. As I was making next to nothing anyway with the site, I shut it down in anger. Pretty outrageous to spend hours working on something and then not only do people steal it but they rank higher than you with your own content!
