Can I use this image in my logo?

I am creating a logo for my new venture, and I really like this symbol and want to include it somehow in my final design...

If you googe "flame logo" you'll see the same symbol in different colours and variations so it would seem safe to use, but how can I know for sure?

    Be sure of this.
    Unless you created the image yourself, or own the rights to use the image: Don't do it.

    There are countless royalty free images and logos you can purchase on line.

    Google: royalty free logos

    Either purchase a design, make one your self or have one made for you...

    Just because it shows up on a Google search result, does not mean it is free to use...

    It is supposedly a public domain image but you don't have any guarantee of that from that site...it was an image uploaded by a user. You won't know for sure unless you track down the creator of the image and find out if he indeed intended for the original image (and it's derivatives) to end up in the public domain. That said, public domain images are not the types of images one usually uses for logos, especially trademarked logos.

    Your best bet is to license an image from one of the legit microstock sites or a reputable graphics and image person that will sell you a license that includes use in logos.

    To make sure you're safe with your logo/graphics/photo, it must be UNIQUE or at least you're the very first to produce it.. if you've googled and found exactly the same design (different colour doesn't count) then sorry your design has already been taken 'just like registering a domain name'. Surely, you can get away with it but the risk is too high such that if you'll become successful with your business, one person may appear along the way demanding compensation for copyright breach. Be safe than sorry but this is just my opinion. Here's a story I've found in the net $8k in Image Copyright Infringement Penalties: Bloggers, Beware!

      If you go to tineye - enter the logo url - you'll find that image used on at least 44 sites/blogs.

      If it were me - I'd hire a graphics guy and create my own "flames" and OWN an image that belong only to me. Wouldn't cost much and it's a better solution.

      or....I'd pay a reputable image site for licensed use of a similar 'flame' image so I wouldn't have to worry about it...

    Thanks for the replies, points taken and will get my own flame designed.

    If I were to have the same style, with 4 sections instead of 3, slightly thinner, would that be okay?

    That might be alright as long as it's different enough to not be called a derivative image. Nobody here can tell you that for sure. If the image truly is a public domain image and you had a substantially different image created then I doubt you would run into issues.

    If you have to question it, even to us here on the forum.... don't use it. Just find something else, purchase a similar image - or even THAT image if it's possible.

    Your best best is to have someone create an original piece.

    The image you referenced is easy enough to duplicate in a vector program.

    That's because the design elements are easily created within Adobe Illustrator and others.

    Just make sure the designer changes it enough to make it unique.

    I would not use this image if I were you. I would hire someone here in the forum to create you your own logo.

      Did you look at the last few comments on the link you posted?

      Ironically, they are being accused of using stolen images to create their logos.

    If you made this images yourself you can use, there is no problem. There are some sites, where this kinds of images available. If you take this images form that sites, then you have to read that site rules & regulations/ copyright.

    Its best not to just download and use just any graphic or photo off the internet... Especially if you are trying to brand something. Putting past copy infringement, the quality of the photo may not be good enough for current and future design graphics. The best thing to do is buy royalty free graphics that come in many different sizes and formats for every aspect of your brand. Take a look at sites like:
