Video game website and content uses : Fair use ?

I would like to create a website dedicated to a specific way of playing video games, this website will also be a passionate tribute to the best video games released. For each games there will be a specific page, with it a mark based on specific criterias related on that way of playing the game. I will heavily focus on the art of games. I will list game rules for each games. In the end this will be some kind of database, with purpose to help the players to play that way, hence there will also be game tricks explanations.

Too many people/players ignores the art of video games and instead just care about the gameplay. In order to illustrate each game pages I will need to use 1-2 or maybe 3 musics taken from the games, and editor screenshots used to promote the game in the past. Since I would like to encourage well thought out games and value creator innovative work, I'd like to make those games more known by the light of the website and ultimately find a way to make those creator make more money so that such games could have more chances to continue existing.

Is this considered fair use?
Is this considered fair use if some kind of monetizations are added (ads, affiliate partner program after each reviews, ...) ?

Thank you for any advices.

    Hello,

This does not fully answer your question, but...

Legally speaking, really, only a judge or equivalent can ultimately rule on the four pillars of "Fair Use"...if you lose, you pay.

The purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes.

The nature of the copyrighted work

The amount and substantiality of the portion used in relation to the copyrighted work as a whole.

The effect of the use upon the potential market for or value of the copyrighted work.
Generally speaking, legitimate review sites often get away with using a few screenshots under fair use doctrine.

Depending on the circumstances and where you are located, if an entity comes after you or your host on a copyright, trademark, or a false light claim etc., one or more of these bad things can happen...you have to remove the offending screenshots, you could end up with a judgement against you, you end up paying whomever for the unauthorized use(s), your site gets shut down, and your host or possibly your ISP get pi$$ed off at you.

I've read a couple of decent articles on the net dealing with copyrights and review site fair use....you should spend a bit of time googling to check current review site SOPs.

    Cheers
