Hi there i use mail chimp autoresponders for my email campains however just as a heads up they banned me!!! telling me i dont adhere to there t&cs which i checked out and i did !! but anyway there reason was this

Hello Owen,Your account was disabled on 8/27 and we sent an email to you and apologize if you didn't receive it!
Looking at the emails you've sent, the content being sent through our service doesn't comply with our terms of use for prohibited content and industries. We unfortunately don't support Get-rich-quick, work-at-home, or earn cash from home type content.
Unfortunately, we aren't able to assist you with your email delivery needs, however your account is open so you can back up your data and obtain your lists at any time!
(AKA bye bye Owen)

i have a list to help people create a website there is no get rich quick scheme or work from home

please anyone looking for an auto responder be careful with these guysas it might not end on the best of terms

and the part i love is that they tell me i can back up my data and lists ect ect basically telling me to go away not even allowed to fight my corner (i dont even fall into there brackets they tell me i do)

please someones advice on a good auto responder company asap thank you
Owen

Owen their terms prohibit affiliate marketing so they may not be the right choice for some internet marketers. I suggest using Aweber, Getresponse or imnicamail.com

Interesting. I guess they want to walk the straight and narrow?

I personally use aweber and with great success and little or no hassles.

I also have 1shoppingcart. I know they recently made changes to the email management functions but I haven't had a chance to check them out yet.

I am not sure if this is entirely accurate.

Their terms clearly prohibit *promoting* affiliate marketing (as a money making scheme), but it appears to me that you would be free to market affiliate products from non-blacklisted industries.

      That's my interpretation anyway.

Anyone else see it that way?

        Hi All,

OK I don't think we have anything to worry about. What I'm saying here in this post is only theory because I haven't tried it yet but I will be trying it as I think Mail Chimp has the best deal going.

I'll also add that this is in no way shape or form me trying to "get around" their TOS. It's an attempt to work within their TOS.

First off I'd say NEVER import a list to Mail Chimp. NEVER Import a list. Their TOS states that even one spam report or complaint from someone on an imported list can get you banned. NEVER Import a list.

Now it goes without saying but I'll say it anyway, ALWAYS get new list members by using the double opt in form. You need all of your list with Mail Chimp to be built with double Opt-in. I don't know if there is any other way to do it with them but if there is DON'T do it. Always use Double Opt-in.

Now here is the "trick" if you will, if your target market is the Work At Home Crowd.

Don't market your "Work At Home" opportunities via the mailings to your list.

Only market to the Work At Home niche products that the Work At Home crowd would be interested in but don't market it as "Work At Home."

So, what are the Work At Home crowd interested in that you don't have to call "Work At Home." What do the companies that are on the first page of Mail Chimp sell? That is what does, PayPal, FireFox, Staples, Canon, Intel, Twitter, Sales Force and all the others sell? Promote those products or types of products.

Here is a list of things I can think of I'm sure there are more.

        Copy writing
        How to create an eBook
        How to build a list
How to set up a "small office" (not home office)
How to contact and sell to Offline Businesses
How to fix PC problems (viruses, spyware, etc.)
How to run a teleseminar, workshop, net meeting, etc.
How to set up a sales page complete with buy now buttons
        How to do research

Inside your/my eBooks there can be info for work at home. It seems MC is concerned with the emails they send out. When you see on MC's home page the list of "Who uses Mail Chimp," you see many companies who serve the work at home niche.

The key here is that they read the eMails you send out. If your emails use the "improper" terms you get busted. Honestly they can't be anti Internet Marketing, their service is pure Internet marketing.

Just to repeat, Mail Chimp comes highly recommended by other IMers and so they (IMers) must be doing it right. I'm glad there is a service that keeps high standards and I want to work within those standards not work around them.

If my "theories" fail, Back to the drawing board.

So my first assignment to myself is to get that first campaign accepted. Wish me well.

xioaphil - this is exactly why I said earlier that I wasn't clear about their terms. I appreciate the corroboration.

Just grin, bear it, and move on to a more professional and more flexible solution. It was nice of them to let you back up your data though....

    Owen,

If you have a beef with this company, take it up with them. Don't come on a public forum, especially where you plan to do business, and post about it. For one thing, it will show up in the search results, and you will be the one to look like an idiot in the end.

Actually, I'm glad he did post.

How many people do you think would not read the tos to discover this?

I know I wouldnt because I wouldnt even imagine an ESP not allowing "work at home" type of lists.

Not getting the "you're fired" email, might say something about their deliverability. :p

        Garrie,

True, But you know what happens when people post a company's name or individual's here in this forum.

Btw, doesn't this autoresponder service belong to a Warrior?

I appreciated this post too. I just did a lot of work setting up my autoresponder emails in MailChimp. Now it looks like I risk being canned because I am an affiliate for a get your ex back product. My fault, yes, but I'm not even clear after reading the ToS. Is that not allowed? Is the owner of MailChimp a Warrior as you say? Maybe he/she will chime in here?

    And what's a "beek"?

Yes, I can appreciate that BUT, the forum's #1 rule is if you have a beef with someone, take it up with them personally - not in the forum.

If the owner of the company is a Warrior, the company's name is assocciated with that person, therefore the rule still applies. And as far as I know, this rule hasn't been changed.

But it could be a review. (Which is the wrong section.)

The #1 rule, IMHO, was to keep bashing out. To keep people from posting so they can get some type of satisfaction.

I dont think he did either.

That could be Garrie, but this thread in my opinion was posted to give this company a black eye when you get down to it. He posted this thread because he was angry because he got banned from using the service - for obvious reasons.

If Owen was going against this company's TOS, then why should he gripe about the company in the forum? It isn't the company's fault.

      No Owen,

I don't have a big problem with it. I was simply pointing something out that should be pointed out.

You are not the traget. Other people need to realize that doing stuff like this will harm your rep sometimes. They also need to realize that just because you have a problem with someone doesn't mean that you should gripe about it in public simply to give them a black eye.

I've been planning on setting up with Mail Chimp for a few weeks now, ever since it was recommended by another Warrior. Banning Work From Home Accounts leaves me out. Ouch. They really look like a great company. I liked the 100 list free feature.

EDIT: Wow, I just checked their site again and now they allow 500 free list members before they start charging.

There has got to be a legal work around. HMMmmm

EDIT #2: Nope no work around. Mail chimp is out except for clients I have who are not work at home companies. These at present include An entertainer to keep up with his support (fan) base and other Brick and mortar businesses.

For our genre of IMers we must do something else.

Right under the Create My Account button it says "By clicking this button, you agree to MailChimp's Anti-spam Policy & Terms of Use." and in the linked Terms of Use it says, in part:

Also, there are some industries that send certain types of content that result in higher than normal bounce rates and abuse complaints, which in turn jeopardizes the deliverability of our entire system. No offense intended, but because we must ensure the highest delivery rates possible for all our customers, we do not allow businesses that offer these types of services, products, or content:
    • Illegal goods or services
    • Escort and dating services
    • Pharmaceutical products
    • Get-rich-quick or work-at-home schemes
    • Online trading, day trading tips, or stock market related content
    • Gambling services or products
    • Multi-level marketing
    • Affiliate marketing
    • Credit repair, get-out-of-debt content
    • Mortgages
So, if that is your business model, and your account is terminated, is it really MailChimp's fault? I don't always read the TOS for services as thoroughly as I should, although I try, but if I didn't, and there was an issue I'd be kicking myself, not bashing the company.

MailChimp did basically the same thing to me. I've heard of them doing it to a few others too. Evidentally this is a pretty common thing with them.

I tried to send out an email to one of my smaller lists for software and they instantly terminated my account. No chance to backup my data or state my case, nada. Lucky for me I already had a backup of my list & autoresponders.

Their reason for terminating my entire account was because they claim a broadcast I was sending out had a few words in it that were considered "spammy" - but there wasn't and the spam score on that email was damn near perfect.

This is going to sound brash - but whoever they have working in their compliance department is a complete moron and should be fired.

I think MailChimp could be a great service especially with the API which is why I recommended it to so many people (including warriors) before, but now I'd strongly encourage everyone to stay wayyyy the hell away from it.

They have good service there, but in future I will leave for Aweber probably...
