Question About Using Somebody Else's Vimeo Video?

So a vendor's product I'm promoting has provided a video that affiliates can use. The only problem is that it's a Youtube video and I don't like having any leaks on my landing pages.

I found the same video on Vimeo that was uploaded by somebody else. Do I need permission from this guy to use it on my squeeze page. Or can I use it on the basis that it's not actually his video?

    Why not contact the vendor and ask their permission to download the YT video and upload it to your own Vimeo account? If they say "yes" you can do it, if they say no, you can't. Either way you've got your @ss covered.

      He makes a great point here. I would also recommend this.

      But, if I were you, I would just use that video. I don't see a big problem there. You should also try contating the creator of that video and ask for permission.

    Tried a similar approach with YouTube creative Commons. Got sales. If it's relevant to your niche do it. Use your face 2/3rds of the time however to build credibility.

    With proper, documented permissions, go for it.

    My guess is that the Vimeo guy is using the old "easier to apologize than ask permission" strategy. Contact the vendor. Odds are he's the rights holder.

    Otherwise, what you are asking is if it's okay to steal already-stolen property from the original thief.

      It looks that way but that's not the full story. The video is 100% in the best interest of the vendor. It doesn't matter what platform it's on, people are more likely to buy the vendors product after watching it. Vimeo is just better for embedding video's because there are no leaks.

      Having said that, I'm gonna play it safe and use the provided Youtube video instead. Peace of mind is better then a small percentage of people who go directly to Youtube.

        You have to see the bigger picture here. Just like protecting trademarks, protecting intellectual property is important because not doing so sets a precedent.

        Even if you use the video in a way that, as you say, is 100% in the best interest of the vendor, the next person who sees what you've done and "borrows" the video may not be as virtuous. Or the next, or the next...

        One question bothers me, though. Not aimed at you specifically, but why do so many people around here have such a huge problem with getting permission to use others' intellectual property? Just look at the number of threads asking if it's okay to use someone else's stuff without asking, when a simple email will likely get a yes or no answer.

    I think your best bet is to use the Youtube video along with the Youtube attribute to disallow relevant videos. This is OK with Youtube as they even do it for you...

    Why not just contact the vendor and ask for the video?

    Contact the affiliate product owner and get his/her permission to market the video on your website. He made it available for affiliates, so.... get confirmation if you feel "stuck", and then proceed with the marketing.
