Help!! How Do I report a fake site (Someone has stolen my business)

Hi,

I just found out from Doug that someone
has set up a fake site same as mine and he even
stole the entire sales page.

How do I report it and get it to be taken down?

    John,

    Report them to their Hosting company for "copyright infringement" (to find their hosting company do a whois check and look for their DNS)

    Also be sure to email them and let them know directly that you're on to them, also threaten them with a lawsuit! It might make them take the site down right away.

    I never experience that. IF me, I'll contact the owner and then, tell them the problem. I he don't shut down the website, try to report to the authorities

    Maybe you could follow the guidelines applied to this situation: contact hosting, contact owner?

    Don't contact the owner. He doesn't deserve to be contacted. Contact the payment processor. They might even close his account. If it is paypal, just call them and explain the situation, fax them something that shows its your copyrighted product and see what happens

      Don't bother with paypal..they aren't interested and won't do anything.

      I had the same thing happen to me , eventually managed to get him shut down BUT it took a lot of effort,

    A DMCA notice will do the trick very quickly. Go to domainingdiva.com ... second post down. I have provided instructions and a sample DMCA notice for anyone to use. I've had great success using it.

      Thanks..after 2 hours of emailing the host....here is their reply

      Dear Sir,

      We had informed the account owner, and will be given 48 hours for the account user to amend or remove the information, should that not to be done, we will take down the site.

      Please note that as its a landing page of an intelligent product, hence if the user had achieved 75% different, no action will be done to the account as according to international guideline.

      Currently, they are 95% similar hence action will be taken to the account user.

      If after 48 hours the site is not amended or taken off by account owner, we will be terminating the account whereby the user will NOT be able to restore it.

        So all they have to do to steal your product is to rewrite the sales page to be 75% different.........interesting

    Good to hear that the hosting company are being helpful and hopefully they will shut that person down!

    It's a shame people feel the need to copy and steal instead of creating their own. It's funny how these people don't realise that if they LEARN the TRUTH about what works then they can TEACH it themselves, from experience, and earn money.

    Oh well, on the bright side, it shows that you make products worth enough to make someone steal your business.

    Hi John,

    As a side note (I totally understand where you are coming from, I had something similar happen to me a few years ago, and it was rectified ) --

    But as a side note -- something that may make you feel a bit better -- even when someone steals a webpage/product like that -- it is not necessarily anything to worry about. This is because many times these individuals don't know how to "market" the product. They think simply by stealing, they will magically get sales. But they don't "know" that you need to do the PPC advertising, the article marketing, etc. And even if they say do "get quick rich" type advertising (i.e., PPC) -- chances are they still don't know what makes a "good" ad vs a "bad" ad (so would end up spending a lot of money). So in the end, while they may see a few sales, it doesn't significantly detract from your own sales.

    The ones who *do* know how to market effectively would not normally steal that blatantly, because they would not want to get caught and risk having their whole business jeopardized.

    So, hopefully that might make you feel a little better

    I feel your pain, John.
    happened to me too, but just like Johnathan said- the person didn't know how to market the service and went out of business quickly, probably assuming I wasn't making anything too lol.

    Let us know whether the hosting company takes him down or not.

      and the owner left some photoshop fake
      clickbank checks....

      it is embarrassing to say the owner may
      be a local as he uses a local webhosting site...

    plus, he successfully listed it at clickbank
    plus he has a linked account selling my stuff....wow...this guy is
    really a con man...

      I got some partners in the webhosting business in Singapore. It's a rather small community. I try to get some details on the guy since he's local. MSN me. =)

        He owns the web host? Good. Excellent, in fact.

        Go to his upstream provider with a copy of the takedown notice, if the site is up or gets put back up. There's a good chance he's going to modify the salesletter to fit his invented 75% rule, which means you need to give the upstream a copy of the product.

        If he's selling hosting and gets shut down, he may learn. The odds aren't good, but it'll crimp his style for a while.

    I am currently working on the you know whats when I found this @_@

    The 75% uniqueness stuff sounds a bit off for me. If the "salespage" is 75% different from yours does that give them the right to sell "your" product(w/o permission)?

      This makes it much easier - get a good lawyer who has experience in this area and work through them. I would not contact the company until I had legal advice.

        Honestly you should put together a report with your tips on how to deal with fraudsters. You seem to be pretty good at it.

        Make sure you stay factual with

      You might want to make sure you get a copy of the product to see if it is the same as yours and then report this to Clickbank as well.

      they close his account....

      The funny thing is when I have exposed him, this is what he replied.

      Dear Sir,

      I had suspended the account temporally until the internal investigation is over.

      Please note that we take copy rights and intelligent property very seriously and carefully at any point of time.

      Until the completion of investigation, no one other then the Company Director have the rights to unsuspend the account.

      More information will be update to you when the investigation completed.
      Cant believe he can still be so calm and I have exposed him.

      Next, he started taking down all his blog's about me page
      BUT I did a live camtasia recording of all his blog and sales page.

        Hey, you might want to see if you can find who the domain registrar is & let them know about it. If it's GoDaddy, I've read of them just taking the DNS records for themselves & never giving it back because the domain registrant broke one of their rules...might be worth checking out.

        The other thing is, I have a hard time believing that slimebag owns a web-hosting company if he's gotta steal your stuff. Now, I'd believe that he's leased a VPS machine from someone else though..might want to do some deeper digging on the IP address to see if some other company's name pops up.

    ALWAYS file a DMCA takedown notice with Clickbank and the webhost in this case. Clickbank, BTW, will take this seriously. If you show that he copied your sales page and product, they'll shut his account instantly.
