FCC coming after "Lead Generator Loophole"

The FCC is criticizing the practice of lead generators obtaining prior express written consent from a consumer en masse by listing a large number of partner companies from which the consumer has also consented to receiving marketing calls and texts.

To stop lead generators from doing this, the FCC is implementing a new rule that requires written evidence of consent from the person called that "authorizes no more than one identified seller".

Has anyone been affected by this? What is your response to this? Is there a workaround?

    Wasn't that rule already adopted in December of last year?

    And is only for robo calls or robo texts? Which I'm glad they stopped.

    You can still as far as I know manually call or email or send direct mail...

    and obviously with the right permissions still do robo calls and robo texts...but who really gives their permission for those?

    I have a related question. How does this work for email marketing? I'm talking about situations where you sign up for one newsletter, and in the privacy settings it says something like "you agree to get emails from our marketing partners."

    Does that still work? Or is it affected by similar rulings (I know not this one specifically but maybe a similar or related one)?

      The FCC is currently only focused on SMS messaging citing the TCPA which does not include email.

      The regulators don't like the "one opt in for many marketing partners" and would love to shut it down every where including email.

      They want a separate opt in for each marketing partner.

    The new FCC rule seems like a smart move to protect consumers from spammy calls and texts. I haven't personally been affected yet, but it looks like lead generators will have to change their tactics. Not sure about any workarounds, but it definitely makes consent more specific and limited.

      They should change their spammy tactics.

      If someone needs to try and configure a workaround...maybe the person needs to reconfigure the whole way they're working on making a buck or 2.

      If anyone's idea of creating wealth is by spamming and black hat ideas, they should realize they seldom work in the long run.

      What's wrong with just being honest and upfront with people?
