Question about Twitter domain names.

Hi Everyone!
I have a domain name with "tweet" in it which I thought was ok to use, now I read somewhere that Twitter wants to trademark "tweet" so does that mean I should terminate my domain now and register another one? My site is about Twitter and I can't think of a domain that I could use, but I could brainstorm and come up with something I am sure.

  • If they haven't TM'ed 'Tweet' and you are using it in commerce before they do, it is likely they won't be able to. Even if they have the guns to push it through, your previous use would seem like it was OK to continue to use, to me. (I am not a lawyer). In either case, right or wrong, they can still sue and cost you money even if they know going in they are wrong. In America, anyone can attempt to sue anyone for practically any reason. The worst they face is being considered 'frivolous' and have to re-pay your costs. But you would still need to pay costs up front unless you were to find an attorney to represent you free.

    Wanting to trademark and already having a trademark are two different things. I would register it if they have not applied for the trademark.
