Copyright Infringment

Hi there,

How different does the design on my site need to be so that I don't have to worry about any copyright issues. I know that I can't take actual code or graphics from another site. But can I use another site's general design structure and model my site closely after it...assuming I actually make all the graphics and code that are used on my site?

Thanks in advance...just want to make sure I do things the right way.

    Hi David,
    Welcome to the Warrior Forum.

Sorry, there's no general answers to stuff like this.

If by "design structure" you mean that there is an image on top of 3 columns, and the center column is wider than the other two, then I wouldn't think that you'd have any copyright issues at all.

If however, you copied the entire look and feel of the site and any special elements that the original site owner considered "his", then the copyright issues would depend on:

    1. Whether they found your site, and whether they considered it an infringement
    2. Whether they wanted to do anything about it
    3. How litigious they are, and how deep their pockets are
    4. How deep YOUR pockets are if you want to argue that your site is sufficiently different to theirs.

(Note: I'm not a lawyer, this is not legal advice, yada, yada, yada.)

    cheers,
    Eric G.
