Autoresponder Legal Issues

I have just subscribed to an autoresponder service called Imnca Mail. The service has excellent pricing and allows single optins.

When you create an email campaign you need to add the unsubscribe link. That is fine as it is needed. But the email generated goes not include some of the other material you see with traditional autoresponders such as a name and address.

Is it legal to send an email that contains the unsubscribe link but does not include the mailing address and other info?

If not, what exactly is required by law?

    Yeah I think that is legal because I send e-mails to all my list with my autoresponder software installed in my server and I never had problems with that...

    But I recommend you that if you use autoresponder of third-parties maybe you have to use more professional companies like you know...Aweber and Get Response...

    That is my suggestion...

    Rich Killian, the owner of Imnica Mail has been around quite a while as a marketer and really knows his stuff. I think you can be confident of not having issues with his service.

      I am not questioning hos product. I think it is quite good and I am testing it now.

      I am just interested in knowing what needs to be placed at the bottom of the email by law. Autoresponders like aWeber require a lot of additional material such as name & mailing address to be placed at the bottom of the email.

    CAN SPAM Require a mailing address in the footer.

    CAN SPAM is a US law, and Imnica Mail is a UK company.

    That being said.... With our new version coming out in April, we will be adding a forced footer, which will include the physical address, as well as an unsubscription link.

    Don't worry, we WON'T be putting any advertising for Imnica mail in the footer like some AR companies does.

    For now, I would suggest you DO put a valid mailing address in your footer till we start adding it for you.

      Can someone post here extactly what is required for CAN SPAM. For example, is only an address required? An example of the format would be helpful.

      Will there be the option to put the unsub and address at the top of the e-mail instead of as a footer?

        James, you can still put it wherever you want, but, it will ALSO be in a forced footer. Footer are is most unobtrusive, and it's where all AR companies force it.

        As I said, nothing stops you from putting it in the header as well.

    What is legally required for CAN SPAM in large part depends on who you are sending emails to and what the topic of the emails is.

      That is the first time I heard of that.

      What I will be doing is creating an optin form. The user will be placing their name and email address to receive more info.

      The autoresponder will automatically be sending an email every few days. It will include the unsubscribe link at the bottom of each email.

      What I have described above is stardard for a majority of internet marketers.

      The topic of my emails will be receiving more info on a team build for a mlm program. This team build will assist people in getting referrals.

      I understand that a mailing address needs to be included in the email footer too. Does the contact name and telephone number need to be included too?
