What would you do about this thief?

What would you do if a marketer/Warrior took your best traffic getting strategy that you pioneered a few years ago and pawned it off like it was his latest and greatest invention, and then used all the materials as the basis for his big launch coming up?

There's no denying this dude straight up pillaged my product and is now giving it away for free. I don't think I'd be so peeved about it if he gave some kudo's about where he learned it from, but the fact that people are thinking he's genius by simply ripping my stuff off tends to piss me off a bit.

The reason I tend to get so sick of marketers is because it's almost as if they don't have a original bone in their body. It's like one big Milli Vanilli festival.

Bring that Milli Vanilli stuff to rap game and you're likely to catch a slug in the chest. Just wondering if I should go gangster rap on this dude or not?

What would you do?

If it's really your product, your idea, up your game.

Always be one step ahead of your competition. But I guess you probably are unable to do that, and instead will get all "whiny" on his butt, rather than getting all "gangsta".

Don't even know who the guy is, and no interest. The guy obviously needs to ask others how to up his game, or what to do with some person who stole his stuff.

I am not a fan of that. He needs to be one step ahead of his competition, at least, if he wants to come out on top.

Just think about this. He is now spending his time concentrating on some tool, because that tool just happened to be a bit clever. So he sits there getting mad, and contemplating wasting his time and resources on some tool, just to keep his dignity in tact?

His original post is the PDF on how to get all whiny. As for the gangsta? It's not even necessary, as he would be stooping to that guy's level to do such. He just needs to up his game, as I said, which apparently seems to be difficult for him, as he is asking us how to do that?

Is it possible that they took your advice (and followed the methods) and then, over time became an authority on the subject?

Only asking because if I studied something over a period of 2 years, putting it all into practice and made a success of the methods. I'd consider publishing my results and findings.

However, I would most likely give attribution to the person who taught me the method in the first place.

I see this happening on this forum all the time.

I have kept an eye on one particular person who seems to purchase other products only to come out with a similar product.

Personally, I prefer people like that for competition.

While they are trying to keep up I am blazing through other creative products or strategies.

    Hey JMo,

At least Milli Vanilli could dance.

What I mean is they were about packaging, but I find it hard to believe that the thief in question is going to present it better than you did.

They may be able to steal your stuff, but they can't steal your personality; that's one thing they'll never duplicate, as well as one of your best selling points.

Those are important points, even if they don't directly answer your question.

    J-Mo,

Consider yourself lucky that it took several years - I've had people doing that to my stuff for many years.

It's seems normal now and I expect someone to be 'pioneering' a new strategy to be pimping something I consider old most of the time now.

Some people call it marketing, but the majority don't seem to care as long as it makes money.

If I were you I wouldn't waste my time giving it a second thought - life's too short.

Your success is not reliant on anyone else so they're not going to stop you getting what you deserve.

Just let it go and move your own position forward.

Being clever and stealing are two different things.

Sadly, piss poor marketers without a original bone in their body have yet to figure this out in life.

I could care less about the money. It's about integrity, which apparently quite a large percentage around here have very little of.

I'm pretty retarded for even expecting much different.

I think this is a ego thing, not integrity.

A few posters in this thread has pretty much given you the idea that the majority of people have no integrity here?

      Then why post here?

You have your inner circle of friends you like to talk about. Call them and leave this forum if you don't like the people here.

I happen to think that most people on this forum have integrity and it has been my pleasure to do business with a lot of them.

This is starting to sound like a temper tantrum/look at me post rather then asking a real question

I'm pretty retarded for even expecting much different.
      We are all retarded. lol

I think you have been in this business long enough to know people will start doing this to you sooner or later.

That is the trouble with informational products.

They are easy to steal, rewrite and pass off as their own products.

True pioneers are few and far between.
      Very true.

I also would bet that your ideas and strategies were created by the ideas that you may have learned from other marketers.

      Nothing wrong with that...

      But hardly pioneering.

Unless they have taken it word-for-word and it infringes on your intellectual property ... there's not a whole lot you can really do about it.

The music industry is probably the best example: These guys steal left, right and center. Remember Vanilla Ice? Yeah, his Ice Ice Baby blockbuster was stolen from QUEEN - UNDER PRESSURE ... he pawned it off as his own creation.

Well, the only way to settle this is to take out the Sledgehammer and go over there, just like Suge Knight who wanted his cut from Vanilla

    I'd simply get over myself....

    It's a bit short-sighted to think that it's a big deal.

Most, if not all of what we see being "taught" about online "marketing" etc, came from somebody else first.

We're just usin' this stuff as a vehicle, the people before us did, and the next group will do too.

I'm trying not to be ignorant here, but it's difficult when we are discussing something so trivial.

Unless of course, he is using your sales copy word for word.. then we might be talkin somethin' different.

I think many of you are missing the point. I don't need or care about the money.

I care about people actually having something original and authentic and truthful about themselves. That's it. Apparently that's too much to ask for some marketers. I'd NEVER work with someone like this.

I wouldn't want to work with him either. I was just trying to think of other
possibilities that might have helped your situation.

Also, if it's not even about the money, I like Dennis' idea. Give away
your product for free! That would give you a huge edge against him
        as a competitor - don't you think?

Sure, it wouldn't resolve your "I care about people actually having
something original and authentic and truthful about themselves."

issue, but then again there are some external factors in life you
cannot control. Perhaps you shouldn't stress so much over caring
about what other people do (within reason, of course).

Sorry if that might sound a little harsh, man. But it's true, don't you think?

Hahhh loved this!! I think you are right to want to do something about it, Jason. I think if we are lax and don't make copy cats and scammers aware of what they are doing they are going to keep doing and just giving marketing and products a bad name. There's no internet police so isn't it our responsibility to pursue unfair and illegal activities so they don't just keep spreading? But to those who think its no biggie and just move on, I'm going to copy all your ideas and sell them as my own next year. just kidding.

    Jason,

My move would be to send him a sarcastic email.

    Something like:

Subject: Joint Venture Proposal from Jason Moffat

Obviously this person would be extremely excited to see this email from you, so click...

It looks like your having a successful launch with (Insert Product Name), I'm contacting you because as you know I have a 15,000 person list in the same niche and wanted to propose a potential Joint Venture.

I will send your product to my list. I don't know how the response will be considering they received (Insert Your Product) already, and both are extremely similar, scarily similar, in fact... never mind.

Hey Jason, there are a lot of good comments here from respected people. I, however, humbly disagree with most of them. Vengeance can be its own reward. It feels good when executed perfectly, and while stepping on one maggot won't change the world, it just might make you feel good.

I consider stealing another's work an act of intellectual terrorism.

Did you ever see the movie Swordfish with John Travolta? Was he a good guy or a bad guy? Hard to tell, but I respect his ideology in the movie. If a terrorist takes out one of our men, we'll take out a hundred of theirs. If they shoot down one of our planes, we'll take out their airport. Like he said, you have to make the consequences of terrorism so utterly horrific that the terrorists think twice about it.

I don't know what your product is, or what his is called--but I offer you this. If you want to give me a copy of your stuff and a link to his I'll look 'em over. If his looks too much like yours I'll eviscerate the dude on my blog and send a rant to my list about it.

Some people think the "eye for an eye" strategy is harsh and inhuman. I, on the other hand, follow the eye--liver--kidney--and a couple unmentionable organs for an eye philosophy.

J-Mo - if it's really about people getting the original product and not a rip off product, here's an idea for you...

Give your product away. You could build a helluva mailing list in the process and render his product worthless. All you have to do is get the word out effectively.

Then write a new version filled with even better stuff and you can sell it to your big new list.

Ok, first off I really enjoy reading posts like these. Having some passion on here makes it a lot more fun. As we all know piracy is a part of the internet, you don't have to go that far to find something that was a copy of some original.

I wouldn't be too worried if I was you. First off, if you are good, the cream will rise to the top. Don't get so worked up about this, you were the one who was smart enough to figure it out in the first place and you can do it again. Secondly, you have to remember that there is way more people out there as compared to the amount of marketers. My point being, the internet is a pretty big place. Who cares if he steals, I am sure you could squash him anyway.

I totally understand why you are upset but I say #$@% it and move on. Use that energy to make something bigger and better.

Invention/discovery are subsets of innovation. So is what you are referring to - sustaining, improving, whatever.

Innovation is a broad continuum. When you improve something, you are innovating. When you create something new and different, you are innovating. And then there are things in between - optimizing, refining, copying and adapting, integrating, etc.

I would restate your point: *most* innovation is of the sustaining variety, then perhaps the integrating variety, and that there is very little true creation of totally new things or processes. Because when you create something totally new, something that obsoletes a lot of other stuff, you have to contend with the cost of adopting the new thing into an environment geared for the old thing. The market decides when that can happen.

I know what JMo had stolen from him and I know by whom.

I watched the video that JMo put out a while back...it was free, but meant as a teaser for his main product, methinks. So unless he gives away that entire thing for free, he can't make this idea any more free.

I don't know about now, but I'm pretty sure that when JMo first released that video, the stuff he taught inside was new - as in, very few people, if any, were doing it.

Now, someone is using calling the ideas within that video their own and making themself look amazing. JMo is upset over the plagiarism.

    So there's the plagiarism issue.

Now that the method has been released to the "public", the person who supposedly came up with the idea will get all the credit while JMo's original product will not.

Say JMo was the caveman that invented the wheel. What happened was, caveman #2 came along, took the idea, and called it his own. Sure, people were going to find out about wheels eventually, but that doesn't change the fact that JMo was the dude who invented it (and therefore should get the credit), not caveman #2.

What would I do? Probably blog about it, but simply to present facts, not to provoke a fight.

    Curtis

Edit: maybe I meant innovation, not invention My main point was that plagiarism occurred...it's easier to know what I'm talking about if you actually watched JMo's video and knew which person did the infringing. Plagiarism is not only naughty, but not allowed! Must give credit to primary source!

There's no denying this dude straight up pillaged my product and is now giving it away for free. Jason, when I read your post, I got an image in my head that might help. It involved a sandy, shallow spot back in the mangrove jungle, some stakes and ropes, a rising tide, some hungry crabs and your thief.

That was quickly followed by a scene from the Eddie Murphy/Dan Akroyd classic "Trading Places"...

Akroyd has just found out that all of his recent misfortunes are the result of his employers' science experiment, and he's sitting on his carpet cleaning shotguns and talking about shots to the knees.

Murphy tells Akroyd that the way to really hurt rich people is by turning them into poor people.

Therein lies your answer. If you can prove that the material was actually stolen and your intellectual property rights violated, sue the sumbitch. Otherwise, put that considerable brain of yours towards the Murphy/Akroyd solution-- how can you profit and cost him at the same time?

I am not a fan of that. He needs to be one step ahead of his competition, at least, if he wants to come out on top.

Just think about this. He is now spending his time concentrating on some tool, because that tool just happened to be a bit clever. So he sits there getting mad, and contemplating wasting his time and resources on some tool, just to keep his dignity in tact?

If I was a bazillionaire, I would get more pissed off about someone taking my work and calling it his own than losing a few measly bucks (or a few hundred thousand measly bucks for that matter).

This business isn't just about making money. What about values? Surely, some people place more importance on good values than on money.

For the person who broke the rules, this would mean taking down the infringing content and publicly apologizing to everyone. For JMo, this does means being (rightfully) more pissed off about the theft than the lost dough.

You know, I should be peeved about the money. But I'm a weirdo with money and stuff. It's obviously not as important as my overinflated ego.

Thing is, I wouldn't be so upset about it if the content was in a members area or part of his product. But it's the fact that his entire pre launch is built upon this strategy.

The reason I tend to get so sick of marketers is because it's almost as if they don't have a original bone in their body.

Jason ... I see a "The Death of Originality" opportunity ;-)

i.e The Death of Adsense, The Death of Article Marketing, The Death of Affiliate Marketing...

Expose it on your blog and do some videos on it.
Seems to have generated lots of attention here.

Oh I'm not saying I wouldn't be pissed solely on the premise of being plagiarized. My articles are all over the internet with plagiarists names on them - and it pisses me off to no end!

The integrity is certainly in question - actually, there is no question about it.

But as a business owner, the money HAS to come into play as well.

haha think i know what tactic youre talking about Jason, you should give this dude an "ultimatum", challenge him to an RV drag race or something. You should see if he bought your course this tactic was in, then you would know for sure he rehashed it.

To be fair though, are you the originator of this concept, cause i never knew you had done something on this and ive been doing it for a couple years now, curious what your product is called?

Might just have pick it up and compare what ive been doing. Always nice to see other marketers using the same tactic but with a different spin.

And there is no way this dude is making 100K a month with this concept selling crappy affiliate products. Even if he was using it to sell his own stuff, he wouldnt be pulling that in.

I'm definitely the guy who did this first. No doubt in my mind. I first showed it in my Video Hijacker product, but had been doing a while before that.

I've seen it copied at least a half a dozen times since then, but this is the first time it's really irked me.

O well, I'm over it. I just made a bunch of money and finished the videos I needed to make today.

Wish I could drown in a cold squeezer though.

      Maybe I'll just surf.

Innovation is fun and exciting - but it can also get you into heaps of trouble if you're not careful. (Business trouble, not legal trouble)

You have to ALWAYS be thinking one step ahead of your thoughts that already have to be one step ahead!!!

Nearly every course out there seems to just rehash stuff. Rehashing is one thing. I actually know what exactly your talking about; the method and the launch that is. And I can tell you there have been a number of wso's that show you how to implement the method. Whether they thought of it themselves is one thing. Perhaps this big launch marketer discovered the method through one of the wso's instead of yours. However, it is possible that he really did stumble upon the method and did not actually know there were marketers already sharing it with the public.

Either way, it's a little late I'll say. Those comments show exactly who marketer x is catering to.

    Cheers

Jason Moffatt, are you a gangster? Then no, I would not go gangster rap on him unless you are a rapper as well.

This stuff happens all the time in the IM world, and even in Warrior Forum. The question you should ask is, will you gain anything by doing this? If you say yes, then you should ask is, do I want what I will gain? If the answer is still yes, then do it.

      Hey Jason,

Like a few other people have said, you can't patent an idea. Same with headlines on your sales letters... your keywords in your site's meta tags... even your domain names can be fair game.

I've had competitors use my PRODUCT NAMES as keyword tags on their videos.

I've had countless people swipe my original headline ideas and reuse them (even here on Warrior Forum).

At least it hasn't happened as often to me as someone like legendary copywriter John Carlton. He markets himself as the most ripped-off copywriter... his headlines have been copied countless times... even by his own students!

      C'est la vie. That's life.

It sucks sometimes but consider it a compliment. If your stuff wasn't highly thought of by someone then you'd never get your marketing ideas swiped or copied.

End of pep talk. Get back to work on dominating your competition for market share. <grin>

      Take care,

      Mike

    Hi Jason,

How about finding a way of owning it. The thing is, the Internet is always full of recycled information. No one can really claim that they are the sole originator of the idea. After all, ideas come from other ideas. One way or another you have to thank someone for giving that idea to you.

But I agree that it sucks that he did not even thanked you. If you know that person, maybe talk to him via email or personally about what he have done. But if you do not know him, maybe he did not know that you have the same idea. Some people have a chance to think alike you know.

But for you, I would suggest owning the idea by being an expert. That way, people will be going to you first when they need to know about something.

I think you should definitely do something to get back at him. I know who you're talkin about and when I first saw the pre-launch video, the first thing that came to my mind was the video of you teaching this exact method.

I can't believe he's trying to pass it off as his own especially because he seems to be getting more well-known in the marketing world and he had to know that it would get back to you. To me, that's like him sayin "I know Jason's gonna find out, but I don't give a $@!#."

I personally have a hard time letting people pull some BS on me and I could never sit back and just "let it go". Maybe it's not always the best decision, but at the time all you can think about is getting back at the person.

Anyway, you could try to ruin his product by releasing your entire method for free like some others have mentioned. I know you probably got a pretty big list and a lot of people that read your blog. I bet a good amount of people that would have bought his product would have no need to if you gave away the entire method for nothing.

To get even more eyes on it, you could have some of the other marketers that you JV with that have big lists give away your version of the product to their lists too. The more people that get it for free, the less he will be able to sell.

Please don't take offense to this "J-Mo".....but I beg to differ that you "pioneered" this little YouTube technique.

Personally, I don't know exactly who did....but I did include it in a little product I launched here in the Warrior Forum over 3 years ago....and I actually started using the technique 4-6 months before that.

I'm pretty sure that is before you "pioneered" this technique at whatever seminar that was I saw the video of.....

Here's the brutally awful WSO video I posted on YouTube (WARNING: turn down your speakers!) -

    February 6, 2007

About 23 seconds in, you'll see the bullet point, "How to Legally "Piggyback" Off the Success of Other YouTube Videos...". Ummm....right there is where I'm referring to the technique of paying people on YouTube to put your link up....or flat out just buying people's YouTube accounts.

Like I said, this was before you "pioneered" it.....(wink)

Fact is, chances are you probably NEVER even saw my product....and even if you did, kudos go to you for having the stones and talent to flat out MARKET and SELL it better than I probably ever could. That's just the way the game works....as a mentor of mine always said - "It is what it is."

It's also entirely possible that the guy you are angry at never even saw your product.....just sayin'.

No matter what....there are some serious LESSONS to be learned here.

First off, an idea that was out there and SOLD here at the WF over 3 years ago (February 6, 2007!) is still able to be sold and marketed as NEW. With the speed at which the internet moves, this is pretty astounding.

Another lesson.....He who markets best wins. It's not who is first or necessarily who has the best original ideas.

I think there are some Warriors who will look at this thread like some of the usual "gossip" nonsense that gets bandied about here more and more frequently than ever. But others will take this and see a world of opportunity and possibility open up....heck Allen Says even kind of wrote about this very thing in his Private Posts ebook!

If it makes you feel any better....just look at me and think at least you're not me. I put this idea in my little course and made a couple thousand dollars from it....I'm pretty sure you made more than that....and now this next guy might even make more than that.

I say, "Good for him!". No...???

No doubt man. I totally feel you to a certain point on this though.

I probably had the same feeling for a second today that you did when I saw that video. Then I just kind of laughed to myself....oh....and banged my head against the wall a few times....LOL!

What it really kind of shows is that your guy Kern's stuff really works.

I was thinking that to myself today....

He's giving away a kick-ass technique right up front and to a boatload of people out there...it's brand-spankin'-new....and cutting edge. He's created a "buzz" with it, and because of that he's going to make some serious bank.

At least this guy seems to have really taken it to the next level though....if his videos are to be believed (they seem legit, but who knows), this guy took some of this to the next level. Alot further than I ever did, even though I thought I did pretty well with it.

Interested to see what he's got to say with this product......

Have a link? Just curious to see if I saw it.

The funny thing is, when I wrote my little course people ran and instantly tried to market "Get Rich Online" stuff with it. But the technique kicks the most tail when you apply it to niche markets, especially ultra-targeted stuff. I still get commissions from links I bought on YouTube accounts that have since been "forgotten" and from videos I put up myself 3 years ago.

I remember people back then telling me I was wasting my time.....even Warriors laughing at me in those Friday night webcast thingy's that used to go on. Good times.....LOL.

There's a certain launch going on right now about buying youtube accounts or paying for links, and it's gonna be a big launch and probably make a lot of money. Come to think of it, I think I know exactly who you are talking about now! It's all got to be in the marketing, because I thought a lot of people knew about this by now, and I don't see the point in paying this fella who likes to show pictures of all the cool places he's been whatever he's gonna price it at, probably $97 or $77 or something, for something so utterly simple.

    Jason,

Why not take the fight to him the right way?

Challenge him to a contest. Relaunch your product, and then challenge him to take 10 people, you take 10 people, and work with them to implement the program.

Think about the potential publicity...You can claim to be the master, he can claim to be the master.. Both of you win, 20 clients win, and in the end one of you proves a point of who the true master is.

Of course, that takes big brass balls, which we all know you have, now the question is, does he?

Screw the brass balls, I'm worried about the work.

Come to think of it, it's entirely possible considering this age that this guy doesn't know that Jason Moffatt did the first big product on this method 4 years ago. Just my opinion. Yeah, it's a really silly move, him thinking this method is somehow revoluntionary. However, he probably has his own way of doing it and his own twist, who knows? How much alteration of a well known method do you need to do to make it your own?

"Good artists copy, great artists steal."
~Steve Jobs, stolen from Pablo Picaso

The first thing anyone should realize when publishing (written, verbal, video, whatever) an idea is that the instant they open their mouth, the idea is free game.

Jason, you promoted for Kern. Did you invent the concept of affiliate marketing to a list? If not, you're a thief by your own definition.

We all learn from others. Dan Kennedy said pioneers wind up with arrows in their backs. Issac Newton had it right when he said, "If I've seen farther, it is because I stood on the shoulders of giants."

      Chill out.

Don't get angry, get even. Create a product on how you can achieve success by 'stealing' ideas from others and claiming it as your own. That dude would make a good case study in the manual :-)

You can do only two things... file a lawsuit or live him alone.

Or... post all over the internet about this guy (wich is pretty boring) you better pay someone to do it.
