Wordpress themes "a question to warriors"

Dear Warriors;
I am planning to sell websites on filppa, and i found some free wordpress themes, i am not sure if they are free or not but they are from studio press and you can find many sites offering them for free, my question is "can i use those themes on the sites am selling?" and can any body discover that it is not purchased and it is downloaded for free? in particular i can find "lifestyle wordpress theme" and magazine wordpress theme, they have an official site in which they are offered with alomst 60 dollars, but as i told you i can download them for free from many sites, will there be any penality???????

    I would assume there would be no penalty, but when flippa assesses your site, it will let others know that there are possible duplicates. I sell alot of websites on flippa, they just want to get paid like everyone else, so they don't really scrutinize.

      THanks for your reply, but i mean with penality the Studiopress it self who is the owner of the lifestyle theme and the magazine theme, not flippa!!!!!! could you please explain me?
