First I would contact him and tell him to remove or you'll file a DMCA with his host.

If he doesn't remove it, do the DMCA

Instructions on how to do it and a sample DMCA in post above.

I solve a lot of legal matters by filing out the necessary court papers, sending them to the offender along with a demand letter to cease or I will file the papers in three days. Learned this trick from an old school lawyer.

I have no agenda but to help those in the same situation. This I feel will pay the bills.

Before taking any step you should first check properly the content of the website whether it is copied or not.

Then you can take the following steps-

Contact with the website owner through email or other option like Contact us, Help desk, Author page if available.

If there is no positive response from him then first send Cease and Desist which is abbreviated as C&D notice to the website owner.

As last step you must send DMCA letter to the webhost of that website.

Then the webhost company is supposed to take strict steps against that website. Even you can send DMCA letter to Google Adsense also if the site is using their advertisement.

Sometimes people grab content from another site cause they *think* it's ok. In fact LOTS of people think it's ok - "if it's in the internet, I can copy".

Why don't you send a message to site owner with CC to hosting company warning about the copyright infringement and asking them to remove the content in X days?

If you put pressure on hosting company, they will pressure the site owner to remove content, otherwise a DMCA can shut them down, and they don't want that.

Keep in mind many IM'ers don't know this is a copyright infringement.

It's true it's wrong. But it really doesn't make any financial sense to fuzz over it unless it's a big company that violates it, which they rarely do. If there's a lot of money by suing, then sue ahead. If not, you should just focus on getting things done instead of being fuzz over someone copying it, if it's good, there'll be people copying you, you can't avoid that.

Right. BUT You need to read the OP:

I have a website related to health and fitness niche and today I noticed that some one else has just copy pasted one of my website article to his/her website without any backlink or any changes at all. If you think it's better to move on and forget about it, great.

IF OP wants to stop it and report it, thats his choice. I just gave him my 2 cents on how to stop it and report it.

Personally - because I have a newbie friendly IM coaching - I can understand why some new IM'ers think it's ok to steal content from other websites - it's one mentality problem of todays kids: it's the IF it's in the web, I can copy it attitude - That includes articles, software, music, movies, etc etc. They don't understand the copyright infringement.

Thats why I advice OP to send one email to site owner and hosting company. Takes less then the time I used to write this post and can get problem fixed.

If you send a DMCA to the hosting company, then the hosting company will contact the website owner. Usually when the website owner gets the notice by email they will take down your content.

With that said, just create more content and not worry about people taking your stuff. I happens all the time and you may be wasting more time sending notices to hosting companies.
