Someone is RIPPING my Product off! HELP!!

hey guys i just found some scum bag rip all of my sales letter and product and offering it around for sale for $37 (he hasnt even changed a single thing) when its a $197 product!, im getting a bunch of refunds because he is bombarding people with emails trying to sell MY product.

How do i go about shutting him down immediately?

i checked the coolwhois and the nameservers just lead to blank pages, ive tried emailing him and got no response etc

    Here is your action list...

    1. Send a cease and desist letter to the thief. You can send an email, but that won't do anything. The best bet is to send it certified mail. If you can afford a couple of hundred dollars, ask a lawyer to write it for you. It will have a much greater impact.

    2. Find out who his website host is. You can do that here: Discover Who Hosts Any Website | Who Is Hosting This

    3. Contact the host and send them a letter that adheres to the Digital Millenium Copyright Act. Here is a sample:

    Dear Host:

    I am the author and owner of a copyrighted ebook that is being illegally distributed via your site. The link is located at http:// (web address)

    The name of the book is My Book. The book is for sale by me at MyWebSite.com.

    My property is being illegally distributed via your servers and I am asking that you cease and desist from further distribution immediately. I am also requesting that my copyrighted promotional material be removed from the website.

    The information in this notification is accurate, and under penalty of perjury, I am the the only authorized representative of the this copyrighted work.

    Thank you,
    Your Name
    Your Address
    Your Email
    Your Telephone Number
    4. Find out who is processing the payments and send them a similar letter.

    5. If the file is being hosted at mediafire, rapidshare, or someplace similar, send a letter to them as well.

    There are five steps to start with. Don't let it go. Keep on after him.

    Unless the thief is in UK you can't do much but try and threaten him (only works if he's a big pussy). The hosts might not take it down until they are completely sure that you are the copyright holder and the product is hosted at their site. File Sharing sites might remove it but it take 5 minutes to upload again.

          Definitely not true. I live in the UK and just a few days ago I sent a cease and desist email to a US host because someone had uploaded one of my products. The host sent a C&D email to the website owner. The product has been removed.

    Bad in the sense that it is a quitter's mentality. There is usually something that you can do about it, but it may take work, no matter what country the server is located in.

      If that were true Sony,Warner, Fox would have got all Torrents, Warez sites closed down, but unfortunately the world doesn't work that way. And people know it.

      When you ask such a stupid question...don't even know how to respond.

      Seems like practicality is not a common quality in this thread?

      Well best of luck trying to sue someone who pirating your product from Pakistan, asking a lawyer to draft a legal notice and sending it via FedEX. I don't say it won't work, but someone who knows what he's doing wouldn't be bothered by a letter from 10,000 miles away.

      If you really want to do something (and if its worth the effort), get someone to DDos his site and his hosts will kick him out on their own without a single letter. Now maybe many people won't like this way but...try yours and try mine...and see what works.
