Copyright on video's?

I'm wanting to make some youtube videos and am wondering if I can use pieces of movies etc, the same way using just a few seconds of music can be free and clear of paying copyright fees, anyone know what can be done with video?

      I know that a couple of seconds of music is copyright free, it sounds like no ones heard of this, thats the philosophy behind the movie download sites that sample bits of movies and reassemble them, they can claim they are within the legal time limit.

        Looks like your talking about "fair use" - where you can use short snips of music and video.

        Such as - if your doing a review of a movie you can show a few seconds of the movie. Or if your doing a review of a book, you can reprint a small snipet, and then write a review about it.

        But - are you planning on doing a review of the product? Or, are you going to use the the video clip for your own personal gain?

        awhile back there was a law suit where a lady used copyright protected music in a video of her baby. The music company filed an infringement take down notice with youtube. The video was taken down, the lady sued the music company saying the clip was used under "fair use".

        Fair use is also what allows people to quote material from other sites

        Yesterday, a federal district court in San Jose refused to dismiss a suit brought against Universal Music for improperly demanding that YouTube remove a home video from its site.

        In this case, Stephanie Lenz was sent a takedown notice for posting a home video on YouTube. Lenz had made a video of her toddler stumbling through her kitchen, then hearing and bobbing to Prince’s “Let’s Go Crazy,” which was playing tinnily in the background on a countertop stereo.
        It’s a mantra in copyright circles: fair use is a fact-specific, case-by-case inquiry. Whether or not a particular use of a copyrighted work is fair depends a lot upon the specific circumstances of the case; broad categories aren’t generally going to cut it.
        But you have to ask yourself - is it worth it?

    That is some really bad advice when it comes to copyright issues. it could land you with heafty fines, and even jail time.

    If it is copyrighted information, such as movies or tv shows, it clearly states in the TOS that you are not allowed to post it without proof of permission to use it.

    never tried to use any copyrighted material myself, so I am not sure how you provide that proof to them.

    Personally, I recommend taking a little time to create something original for your videos. it doesn't take long, once you get into the groove.

    I make power point videos out of my articles, and they do fairly well.
    They usually play nice and give you a warning, but legally, they don't have to.

    they have been cracking down on this lately, and removing videos that violate copyright infringements, and removing audio tracks from videos using copyrighted music without permission.

    If I wanted to possibly infringe on copyrighted materials, I think it would be cheaper to hire a lawyer than it would be to pay the fines.

      The toddler video was not made for profit - thus fair use might apply but only a court would make that decision.

      If you are making videos for profit - using copyrighted material in your videos without permission could mean you beg forgiveness....and pay the bill.

      If you choose to do it - you accept the risk of what could happen. Maybe it will be ok - maybe not.

    First of all and of most importance - you are seeking legal advice from forum attorneys.

    Secondly, as it stands right now about two weeks ago the FEDS shutdown about 73,000 blogs for a similar issue.

    In addition, more and more attorneys across the nation are now finding that these types of lawsuits are becoming bread and butter income.

    Meaning those with "Copy Rights" are hiring these attorneys to go after offenders.

    The attorneys in turn see it as a numbers game. They file as many lawsuits as possible [throw enough mud on the wall mentality] and push to get as many people as possible to settle out of court.

    They are doing this with videos, content and news stories.

    Do yourself a favor; if you are going to go down this road, talk to an IP attorney and know the LAW.

    Oftentimes, you can get a no cost first consultation with these types of issues since you are asking somewhat of a common generic question.
