How does one know if a PLR article or package is or isn't copyright?

For example, I found a package and googled the articles. I found that most of the articles in the package were scattered througout the internet. Clearly, the articles in the package weren't copyright because there were numerous authors who posted them.

Is this the only way to check the legality of the PLR articles? Can one assume that if an article is all over the place then it is within the public realm?

    PLR articles are usually sold with rights and that is why you see so many people publishing these all over the web. Now, with so many people buying, selling and using PLRs it is almost impossible to determine if the person who sold it to you actually wrote the article. I think your best bet is hiring an article writer and paying that person to write articles targeted to your particular niche and with your specific keywords and recommendations. Always keep in mind that when it comes to factual information you will always find SIMILAR content, but the way it is formated and presented will always vary. Ideas, if copyrighted is a whole different story, but articles tend to be based on factual information which in turn will be repeated a number of times in a variety of methods.

      True. Unless you know the original source, you really don't know if the writer retained the copyright or not.

    PLR articles come with a license, which is a list of things you can do with the product.

    A ghost writer who will sell the ebook as PLR would relinquish all claims to copyright and turn it over to the client. The client then sells the ebook with a Private Label Rights terms of license.

    Some PLR packages clearly state that purchasers may not claim copyright but others may claim copyright only if a substantial change has been made. To make sure you look at the terms of license or you hire a ghostwriter to write the ebooks.

    Just because there are various 'authors' claiming to have written a piece does not mean that copyright does not exist. Copyright and authorship are two different things. It is perfectly possible for the original author to retain copyright whilst allowing others to claim authorship.
