copyrights etc, what about ...?

I'm going through my piles of pdfs, all IM teaching stuff, seo, getting traffic etc, sorting out the ones I could use for giveaways.

I have a bundle that have a nicely written earnings disclaimer at the start but there's no mention of copyright or resell rights at all. Do I assume that these are public domain and are safe to giveaway?

I have others that simply start right into the document, with no preamble about rights, copyright, disclaimers etc, nothing. Can I assume these are safe to giveaway?

Normally I'd avoid these but there is some quality material in there that'd make a good promotion.

    No. Once a work is committed to a fixed medium (your PDF) it is copyrighted. The copyright notice or mark has not been required since 1974.

  • I agree with Michael, when in doubt just don't do it. However, if what you are going to do is give it away, then I do not see a problem with it as long as you do not promote that you are giving that particular item/ebook/software away. If the copyright holder is still making a few bucks from selling it, the last thing he/she wants is someone announcing they are giving it away free.

    So, avoid headaches and unnecessary complications, just do not assume you can do it.

      But the copyright owner MIGHT have a problem with it. Part of the test of infringement includes situations which may hinder the original copyright holder from earning money from their work. Giving something away for free DEFINITELY would impede the original owner's ability to monetize their work.

      Think of it like this:

      Imagine if you gave away free copies of the latest blockbuster movie release that just came out on DVD. You're just giving it away, not selling it at all. You're not making any money on it directly, but do you think that a court would decide that giving away hundreds or thousands of copies of it for free -- even if you didn't advertise the free copies -- had a negative impact on the sales of the DVD? I think there's little doubt what the court would think of that.

    You can not give to any body else. You are not permitted to give away to any body these PDF files. It does not whether Copyright or disclaimer is mentioned or not, you can not use it because the copyright notice or mark has not been required since 1974.So you should care about it.

    You have no give-away rights unless it is stated that you have give-away rights.
