Loopholes to outright theft

You all will really like this one. Especially if you offer out products as WSO's. There is an individual who has found a loophole in the law. This person has put up several websites with the canadian web hosting agent, iweb and is sharing YOUR wso that they've not only stolen from you but are making money on it with their web sites.

I've currently found over a dozen of these sites with just about every WSO that is posted on this site.

So, what's the loophole? Canada doesn't have an equivalent of the digital laws for copyright protection that are in the US.

I just got off the phone with iweb and the only thing that will bring down the websites in question is a court order. And as you can guess, it could cost $$$$ to get the court order.

So folks how do we combat this problem? Right now all of your hard work is profiting someone else and they are getting away with it!

    My advice would be not to waste time worrying about thieves and concentrate on the honest folks who are willing to recognize the work you have put in and pay for your services.

    Unfortunately there have always been people who are ready to steal from honest hard working people. Even the big boys get their books , software , music and films pirated and sold , just make sure your products are top notch and you might eventually get the end readers to become your full time customers.

    You can't do anything about it. If it isn't a US site with a reputable host, you're wasting your time. Take down the ones you can (US hosts) and ignore the rest. All you can do.

    I don't blame you for bringing this up, but the mere fact that you did just gave a lot of people who never would have thought to even look elsewhere the idea to look elsewhere. This is a problem better left (by us) unspoken. In fact, I just made it worse by keeping this thread in the limelight. D'oh!

    Well, it is in their Terms that you cannot host copyrighted material on their server:
    Acceptable Usage Policy from iWeb
    Transmission, distribution or storage of any material protected by copyright, trademark, trade secret or other intellectual property right without proper authorization, and material that is obscene, defamatory, an invasion of privacy or constitutes an illegal threat, or is otherwise illegal.
    And if there is enough pressure... they take down sites:
    CBC News - Canada - Hamas, Hezbollah websites hosted by Canadian servers

    Well I do have an update. I will unfortunately not give the links as this would make it so much easier to get pirated stuff.

    Next, iweb may have a terms of service, but you can only prove that you are the copyright owner with a court order.

    Finally, I discovered that you can complain to google and get the page deindexed!

      I tried the Google route and they did nothing. Did not deindex the sites. If it is copyrighted material, they also require a DMCA from the copyright holder before they will remove it. But if you submit the DMCA, they will deindex it.

    File a DMCA with the webhosts ISP or the backbone provider in the US.

    I know this works because I had someone complain to ATT who then gave my NOC 48 hours to answer the complaint. It was for a bogus spam complaint but a pain since it was files at the backbone level.

      There is so much out there on these type of sites... I agree with just focusing on the honest ones, and don't waste energy and valuable time trying to deal with those who aren't.

    That isn't really a loophole. Canada, last I knew, HONORED US copyrights! So one relatively new law REQUIRING a third party to cease and desist in the US, is not in canada. Fight it the old fashioned way as copyright infringement, and if the webhost connects directly to a US resource, or is based here, go through THAT!

    Too many people lie, or exagerate, etc... so defamation here is frowned on at best, etc... So I think paul is saying you shouldn't even ASK for links to offending sites.

      It's a master plan, find the hooker, get the pirates ip address, find him (or her, oops, may need a male hooker), get hooker to sleep with pirate, steal medicare card and we only give it back when the sites are down.
