Something I've been wondering about; if you had owned youtube.org or clickbank.info (or any other big and already registered .com-domain), what would you do with it?

    If I owned one of those I'd probably spend time responding to letters from the legal teams of YouTube or Clickbank.

    Back in the days you could actually make some money buying up domains with large company names in them. Today, you will not own those domains for long.

    Much like mojojuju I'd be looking forward to writing witty replies to the legal teams of the aforementioned companies.

    If I really wanted to annoy them further than registered domains using their trademarked names, I'd spend some time defacing their logos and ensuring that I used them at the top of any letters I sent in reply.

    Simple solution - Don't bother with domains that contain trademarked names. Especially not REALLY BIG companies!

      Here's a funny story about that.

      The marketing department of a client corporation contracted with the advertising agency I was contracting at to buy up related domain names. We had a rather large budget and bought up between 200-300 domain names all of them trademark terms. About a week later, the client company's legal department sent us a "cease and desist" for each and every domain. We had to get the two departments talking to each other via a conference call to clear things up. Fun stuff and the lawyers still weren't amused by not being told about it ahead of time. They must live a humor-free existence.

        Absolutely hilarious! At the same time, it is kind of scary when you realize how little the top brass at a large corporation actually know about what's going on within their company. One arm doesn't know what the other is doing, and this can lead to disastrous consequences if things are allowed to go too far.

    Yeah, I agree with the other comments.
    I think you are asking for trouble today by buying a domain that is trademarked by big companies like these.

    Not worth the trouble in my opinion!

      Isn't the key to the question, "had owned" ?

      Apple paid a ton of money for iphone.com and will shell out a ton of
      money for ipad.com.

      If you bought those after the product came out, you would
      then be accused of cyber-squatting. And may get sued.

      But ICANN cannot just take a domain without some sort of court or legal
      panel making a ruling.

      The thing is, if you have developed it, your host would get a letter
      and they probably would turn you off. But the domain would be yours
      until forced by some legal decision to give it up. If you could prove you have
      a reason for it, well, ...who knows. In the case of clickbank, if you owned
      a bank, and called it Click, you may have a case. There are many companies
      that share the same names, but they are totally unrelated to each other.

      If you had owned iphone.com and apple came out with a product, you would
      then be rich after selling it. Which happened.

      However, many companies refuse to pay or litigate. So, many brand names
      in domains are owned by regular people.

      In the case of iphone.com, there was no way apple was going to be awarded
      the domain. So, they had to pay up or not use it.

      BUT...do a search for iphone and you will get a ton of domains with iphone in
      them. Apple loves publicity and have always let their fans have a lot of leeway.

    hmm.. how about the "less bigger" names?
    Do you guys think it'lll still be called "Trademark infringement"?

    I'm asking, because I do own similar domain names of some companies selling affiliate products, and I DO have their permissions to promote their site using the domain name I own.
