Mining YouTube For Content? Legal?

I want to know if you are allowed to take youtube videos and post them onto your own website and then profit via ads or aff links.

I know we all do it. I know some even profit from it, but is it legal? And if so on what scale does it become illegal if at all?

And even further how does adsense come into this, does youtube take the whole lot from the invideo ads or do you get a percentage from embedding the video onto your website?

    That's a good question maybe they have in there rules. Right off hand I really couldn't tell you. But they do give you the embed link so it might be legal.

      Does the content get indexed in the serp via your website or youtube's?

        There is no content. Video is not read and the ID is a random number, so not even the name of the video is available to be indexed on your site.

          Then why do youtube video's always get indexed super fast and always end up one page 1 ?

            The reason im asking is because im developing a video sharing site and in the beginning i wouldnt mind using specific you tube content but im not sure how they will respond.

              As long as you comply with YT's terms of service, you should be in good shape. On the odd chance you do get a legitimate takedown notice, all you have to do is comply with it.

              Two things come to mind...

              > Since they can't yet reliably 'read' and index the actual content of the videos themselves, they have to rely on things like the description, tags, links, etc. These tend to be pretty keyword focused.

            Because the page at YouTube has content, is owned by Google and so completely optimized for their search engine. Getting the page embedding the video to #1 is a totally different ball game.

            You notice most/all of the Youtube 'tricks' entail using keywords or descriptions similar to popular videos and then putting your link in the description. All that is on the Youtube site and not an embedded page.

    Not every video is embeddable. The embedding is easily turned off by the account holder for any video they wish.

    The only issue is when you embed a video uploaded illegally. At that point, Youtube is usually contacted and the video removed. I have never heard of anyone in trouble from embedding videos from other accounts, only ones they illegally uploaded 1st.

      There's been a handful of cases where sites specifically made as a library for pirate videos on YouTube and other video sharing sites have been forced to close by rights holders and their representatives (like the MPAA). They may not even embed the videos and just link to them.

      In addition if you embed a YouTube video that is pirated you may be contacted with a takedown request. Under U.S law if you don't take it down there may be liable for infringement.

      Also some companies/rights holders make up their own version of the law and may try to threaten you to pay them royalties or sue you. Just cause they are wrong doesn't mean you won't have to pay money defending yourself in court.

      All this is pretty rare but it does happen, especially as your traffic grows. In the vast majority of cases the host (e.g YouTube) is the one that gets the takedown requests and legal pressure.
