Planning a website and want to have a member generated image gallery.

I don't want to let members upload copyrighted material but it is obviously hard to moderate.

Is there some sort of disclaimer I can put up to stop me from being sued if one of my website's users upload copyrighted material?

    I'm not a lawyer and I never played one on TV -- but I have a disclaimer that says that my site isn't responsible for copyrighted material, that it is the poster that is responsible .........

        Actually, it's not foolproof, but if you want to get technical, nothing is completely foolproof. If I suspect that someone's posts or pics aren't their own, I usually talk to em about it. In my genre, my users aren't real savvy people about cyberspace. They can tell you a hell of a lot about earth sciences though, LOL.

        When you get as big as Youtube, someone is going to be camping 24/7 to bring you down anyhow, no matter what your TOS is.

    Yes, there are specific legal requirements that must be met to avoid copyright liability for members' uploads.

    It is called a DMCA notice. If you need more help figuring this out post it here. A sample one is included in the forum's TOS everyone has agreed to.
