On October 19, 2010, Facebook filed three separate lawsuits all involving use of the Facebook platform to engage in what Facebook considered fraudulent activates which were monetized through CPA networks. The lawsuits named Steven Richter, Jason Swan and MaxBounty. as defendants. Two of the lawsuits named individuals and not the respective network as defendants.

    Sad to think of the good CPA people (the ranks of which I will be joining shortly) who will be damaged by this.

    Ah, well... E-mail marketing survived CAN-SPAM, and CPA will survive this. A powerful lesson for all.

  • This is a real shame. All some people are going to see is " affiliate marketing scams" , they're not going to read the rest and now legitimate affiliates are going to have to bear the brunt of it. Oh well, it happens and we'll adjust.

      Not exactly true. FB don't care for any IM niche products either. In fact, I've heard they won't allow them.

    They may have been doing some stuff that was shady and violated the rules, but this is probably going to start to affect the good guys who are marketing legitimately. It's too bad because Facebook offers a lot of potential to Internet Marketers because they have such a captive audience.

      Well it could affect IMers by cutting down Facebook allowing it, but don't expect stuff like lawsuits, etc., as marketing wouldn't be illegal.

    One example of the fraudulent Facebook Pages titled “Upgrade your account to Gold today!” encouraged users to upgraded to a Gold Facebook Account to receive “perks” which included “video chat”, “group chat”, “profile view notifications”, “themes” and “no ads.” The Page appeared to be operated and authorized by Facebook.
    Once again, some very shady and clearly fraudulent activity. This reminds me of that thread about the Canadian spammer who got nailed for 1 billion for basically hacking into accounts and sending out spam emails.

    I have a feeling that people will read these types of articles and come to the wrong conclusions -- that spam (outside of email) is illegal, or that selling CPA is illegal.

    Also, Jason Swan (named up their as being sued as well) is the CTO of CPALead but I imagine he did this on his own time/resources apart from the rest of the crew. I hope so, anyway!

    Ohh..I think this has something to do with some (oh they were not just some, they were too much!) facebook messages I received some weeks ago about free ipad/gadgets. They flooded my inbox with this stuffs. Sigh~ They can promote but spamming was like... too much already, and my email spam box is full too.

    Yes it hurts image, but its time for a shake out. Facebook will control the money made on Facebook. If you think you will continue using facebook as a marketing ground, you are wrong. Ask the group being prosecuted 6 months ago if what they were doing was legit, I am sure they thought so. The game changes. If you do not own the site, it may be and issue.

      If any of them thought it was legit, they are too stupid to breathe air. Of course they knew they were spamming and violating Facebook TOS as well as CAN SPAM. Don't even try to imply that it was all just an innocent mistake.

    It will force a change so that more legitimate offers are displayed to users on FB. I personally hate most offers I see on FB as they are just junk. I am sure that it will affect the good marketers as well and that is always annoying but change is inevitable.

    Yes, what they did was clearly against the intended purpose of those CPA offers. They mislead people. I saw it myself through my FB friends. Click like to get a $500 IKEA gift card. When researching a CPA ebook, I noticed how much of this garbage was being filtered out to the masses too.

    Is the tactic breaking rules? If it is, then you may have to pay the piper somewhere down the line.

      Why some marketers believe that every single site/platform out there is an open ground for them to do whatever they want?

      FaceBook?

      This reminds me of silly street salesmen who think every crowd on the road is a potential opportunity..and get what they deserve of cold shoulders and hopefully a bunch in the face.

      FB is a SOCIAL network, people are hanging there with their chosen friends, to have fun, to play...to seduce...whatever..

      FB can be a marketing channel?

      Only in a single way. to convert your prospects into friends, let them see your social side, to make them feel more "comfort" with you..knowing that you're a real breathing human who can be funny and nice to hang with...

      All these FB marketing tactics are just making me crazy...

      One question in closing:

      Did you EVER purchase a product, or have an interest in an offer through a spammy FB message?

      I hope more logic and sanity take place one day in the IM world.

    This is just one of those cases of people willing to do anything for some $$$, Legit, or not, in this case "Not!" FB Is just responding accordingly, they want to protect the integrity of their network, simple as that. I would Sue them too. Spammers are scum. Whats funny is that Legit CPA Marketers make more than these scammin retards any day, so why dont these dudes just go legit? Who knows. We may never know.
