Need Serious Help Setting Up a Store for a Defense Fund

Hello Fellow Warriors,

I'm looking for a few people to help me with a project I'd like to get launched and running in the next week.

Here's the story.

Last year I promoted the Kimkins Diet. After a big promotion that went off in Womans World magazine, the site went from 2,000 to 40,000 members in a months time.

The founder of this diet Heidi Diaz (aka Kimmer) had been very private up to this point. Some problems with the diet and the founder surfaced, and it was found out that Heidi Diaz was not the woman in the pictures used to sell the diet, and that Heidi Diaz despite her initial claims of losing 198 lbs in 11 months was actually obese.

I have been involved as an activist - spreading the news of the fraud - and I am a member of a class action lawsuit.

In the past few weeks my name was put on a SLAPP suit filed by Heidi Diaz and Kimkins. Her suit lists some people and 100 "does," to be named as she aquires names of people to add to her frivolous lawsuit. Her lawsuit is an intimidation tactic against us, and very likely will be tossed in the future.

While our lawyer John Tiedt has been gracious enough not to charge us for his time, there are things (responses) that need to be filed with the courts. There are filing fees that will need to be addressed, period.

Right now, those fees are looking like roughly $300 per person named.

We have a trust put in place by our lawyer, but some people have expressed concern over sending money that seems to go into a black hole.

I have a solution - a way for people to not only contribute and feel good about doing so, but to also let them get a little something in return.

I am in the process of trying to put together an online store. The store will be featuring items that the anti Kimkins movement will be interested in purchasing. Profits from items will be sent to the trust for the defense fund.

At some time, those filing fees will be returned when the case is found in our favor, and I would like to continue to leave those funds available to others to use in future litigations and other online lawsuits.

I have ideas for merchandise, and plans to see what is involved in getting an account with printfection or something similar.

I'm looking for advice or ideas on the best way to set up this store - things I may need to be careful of - as well as some minor technical assistance to set up a proper payment processor.

I need your help. Please if you could raise questions here that I need to consider, concerns, problems, etc. And if you are in any way able to help me get this off the ground and can donate an hour of assistance please let me know.

What do I have so far? I purchased a domain, but may change it. I have hosting space, and know how to get a basic blog up in seconds.

I am looking for some digital download items (patterns on making sock puppets) to include as well as t-shirts, etc to sell.

My funds are extremely limited in setting this up. I have spent so much time on this problem for the past year that my own business makes enough just to pay it's monthly cost of running. So, if you have a software or something I should be using and can donate the use of it for just this fund raising site, I greatly appreciate it.

What I have never done is accept direct payment for items - set up a shopping cart - or allocated profits to go to another source.. I need a good solution for tracking information and automating as much as possible.

I need serious help with a plan for this. I'm just not sure on the best way to set all this up.

Should anyone want to just contribute directly to the defense fund, I have the information for that here as well - and trust me, some of those gals and guys involved will really appreciate even five dollars.

This particular lawsuit goes way beyond just fraud. The diet plan of Kimkins has caused PHYSICAL issues for some of these folks, and was a recipe for eating disorders. Heidi Diaz is an extremely dangerous individual online. She has lied not only to me, but about me in court depositions.

Please let me know your thoughts, and here is the direct donation information for anyone in a good mood today. Here is an excerpt from my friend "Prudentia."

"A response has been received by John Tiedt, the attorney representing the plaintiff's class action against Heidi Diaz, from her attorney, Bert Cottle, in reference to the status of the cross-complaint (the SLAPP suit) filed by Heidi Diaz.

First, this is a direct statement from John, which he has asked me to share with you all:

"The cross complaint filed by Bert Cottle was designed to intimidate the plaintiff's witnesses. We intend to file a motion to strike and seek monetary sanctions against Ms. Diaz and Mr. Cottle."

In addition to the above, I have talked to John and we are setting up a defense fund to help defray the filing fees and costs that will now begin to accumulate in this matter. If you are interested in contributing to this fund, you may do the following:

Checks or money orders: Make payable to Tiedt & Hurd Trust Account

Mail to: Tiedt & Hurd Trust Account
c/o Barb Lewis, The Witness Intimidation Fund
980 Montecito Drive, Suite 209
Corona, CA 92879

Credit or Debit Card: call Barb Lewis at 951-549-9400"

Thank you to who ever is still reading here and for hearing me out.

    Hi, Jill,
Helping my friends with their legal problems has not only educated me on the horrors of the legal system, but the outrageous costs involved to defend one's self against unfounded allegations. So, I support you, but sorry I can't contribute!
I suggest you look into cafepress as one of your 'stores'. If you can come up with a nice graphic or two (one just nice, one directed toward your cause), then set it up to be on t-shirts, mugs and all the other stuff they offer it might work. It's free and you don't have to concern yourself with shipping and payments. Put a link on your site and it takes your visitor directly to the sales page, as if it is one of your site pages.
    Good Luck!
    Kate

Thanks Kate! And you're a Carpenter too! LOL

I will definitely look into that.

The current domain I have is sockittome.info. I chose the sock it to me for 2 reasons. One, so there is a feeling of "go ahead and try to sue me for being an activist" and the other thought behind the socks it that in this scam (as I believe with other online scams) there are many "sock puppets" created by the scammer.

The initial thought is to sell socks, sock puppets, and how to make sock puppets or sock puppet kits. I have even written Etsy to see if I can get their home crafters involved and promote the etsy site as well.

With this particular case, "ducks" have been the mascot of the scam fighters.

There was apparently a point where anyone on the Kimkins site with a duck avatar was suspect of being anti-kimkins, and they would be banned. It became a joke, and many of us use ducks now in our avatars and lots of rubber duckies.

I'm going to work with some others as well on things we should put on t-shirts. Ducks, and such that anyone can wear.

I think a lot of times people associate a negative connotation with getting sued. It is a shame that money keeps people from fighting for what is right, and people are also afraid of their name being dragged into litigation.

We have a strong group that has been working on this, and their blogs plaster the front page results for a google search on "Kimkins." Apparently we bloggers have had some kind of impact on her economic advantage. LOL Like it has nothing to do with joining a diet site that was built on lies by a woman who doesn't even follow her own diet advice.

She is not your typical scammer. Members were banned from lifetime memberships, and at one point she tried to convince everyone the site was under new ownership. She has used so many sock puppets: ie Vanessa Sharp my affiliate manager doesn't exist. She has even admitted to using her own families names.

This lawsuit is not about the money. I'd be getting a whopping $39.95 for my efforts.

The sad fact is that she is a bit of a marketing genius, but unfortunately is not a trained health care professional and has no business running this site. Her fortune was built on a huge heap of lies. She has tried to clean it up and scrub the site. Too little too late.

Anyway, Cafepress may be a fantastic jumpstart and I can simply do a redirect on the domain for now.

        That's horrible.

But I just wonder - did you do any homework before promoting her product? We all know that on the net you can be whoever you want to be.

Does the diet work? Surely that's the important question. If it doesn't, should you have been promoting it? If it does, then why does it matter if she's a failed dieter?

I don't want to sound unsympathetic because I realise having a lawsuit against you is seriously not good.

I did the diet, and lost weight - because it is a very low calorie diet. Many lost weight, But Heidi gave additional personal counseling to members encouraging many to go to 500 calories a day or less. We were told that if you have fat on your body you can't starve to death. She did a podcast with Jimmy Moore of Livin la vida lowcarb while she was obese, all the time continuing on that she was thin and healthy and promoting her diet.

I joined the diet believing the story on the front of the site and that the pictures of the founder were real. She claimed to have maintained the weight for over 5 years. She started dishing out her advice YEARS before starting the paid for site, and used a fake picture and stats then as well. This was a con that was years in the making. The woman lied and said she had to keep private because of foster children - which she did not have when creating the Kimkins site. She lied about a lot of things to make herself sound like a wonderful person.

So, I did the diet and sold it as it was "working" - and discontinued as soon as I realized the dangers of the diet and the scam underway.

There was not much information before - so no matter how much homework I had done it would not have helped. She hid behind the name "Kim Drake" and went by "Kimmer" - no one knew anything about Heidi Diaz. When She was caught on video tape, she stood behind saying that Kimmer and Heidi Diaz were 2 different people. It took video footage from a PI to get our proof.

Answer: The diet works because it is starvation. I did not realize how dangerous it was while I was doing it. It matters that she can not do it because she convinced everyone she had done it and was still maintaining over 5 years. Why won't it work for long term? Because it will trash your metabolism. It will eat away at your muscles - and your heart is a muscle. As I write this, there is a member still supporting the plan who is having serious health and I believe HEART issues. There is a "high" that is created within the forum. Everyone is losing a pound a day and it is a rush. You are made to believe that if you are not consistently losing, then you must be cheating and you are encouraged to cut back more and more calories per day.

She sold the diet as an "authority who had done it" and it is obvious she has not done it.
