Trademarks and protecting yourself...

I have a question which is proving to be quite a stress.

I have a mega busy forum and recently a competiter told me that they were looking at registering a trademark.

Now, what I am worried is that what if my competitor decides to register my .com domain name as a trade mark? I have been using this .com for maybe 5 years now...

The other thing that is baffling me is that when I phoned the trademark office in teh UK to discuss registering my domain name as a trade mark without the .com they said that it described what it was tooo much and would be declined.

Now I go and see another site who uses the same domain name layout as I do and they have the letter TM after their name.... and yes this companies other branch is my competitor.

What can I do? I dont fancy getting screwed over

    You will need to talk to an attorney, but there is a "first use in commerce" clause in trademarks that may help you, but like I said, only an attorney can tell you for sure.
