Using pictures of other marketers WITHOUT their permission...?

Hey.

Are you allowed to use pictures of other marketers on your site(without their explicit permission)? :confused:

I want to add a 'fun' element (so it's nothing bad or misleading) to my header graphic on one site - with me beating up the gurus (or something of that nature + blood and gore).

So..

Is one allowed to do such a thing without getting into done for defamation or something?

Shed some light! (cough cough...Mike Filsaime would be one such candidate.)

        Yep, very unlikely to get a reply. Only a few gurus do reply their emails.

          That's one of the reasons I hope I never become a guru. I try to ALWAYS answer emails sent to me (directly...not autoresponder stuff).

            When the number of emails you get per day reaches several thousand, and the number of PERSONAL emails reaches hundreds, that may be tough...

            There was a thread here a while back that discussed the use of images in pretty good detail. Try searching to see if it's still around. There was a lot of debate as to what is legal and not leagal, fair use, ect.

            At the end of the day, most of the "gurus" who have their images used all the time without permission don't really care unless used in an inflammatory way.

            When in doubt, ask an attorney.

        Couldn't hurt to attach an already made example... that might get their attention.

        But I think you may have some troubles with deformation unless you get written consent... law suits could follow saying that the 'guru's' pictured helped increase conversions and they want their piece of the pie!

    If the images in question are in public domain, and expressly stated that you can in fact use the images on your own website, I would say ok...

    Well, one of my friends made a video in a completely joking manner and it included pictures and names of some top marketers and was joking about them... he got a "Cease and Desist" from one of them.

    That's a fast track to a lawsuit if I ever heard of one.

    Here's a better idea: Get a picture of a real scammer and do that. They wouldn't dare sue, you might prove it.

    Hi

    Maybe you need a gripping title for your emails like, 'Your picture is all over the internet!'

    Obviously don't publish their picture before this but tell them what you are planning on doing, send them an example and the benefits for them. Then ask their permission.

    That may make them open it and read.

      If you don't have it in writing that you can use each picture, don't do it.

      Why not just hire someone to make a caricature of you beating up gurus. The caricature will probably look more guru than the real gurus too :-)

    You need to be very careful with using images in this way. What you may think is hilarious may be offensive to someone else, and that someone may have very deep pockets.

    You should take this one to an attorney, but my own opinion is that it is a bad idea for two reasons.

    If you're David Letterman or Jay Leno, you do spoofs for a living and the public will assume your presentation is in jest. Otherwise, your actions might be interpreted as malicious. Libel is a tough one to prosecute, but unless you have a lawyer on retainer, no reason to set yourself up on the receiving end of something like that.

    Second, "public figures" loose some rights to the editorial display of their likeness. The big question is are these people recognized public figures? Probably not. Thus, you would need their permission unless you want to risk action against you.
