Is it o.k. to put images from Amazon on your site?

I'm building a product review website and haven't signed up for the Amazon Associates program yet.

I wanted to know if I can pull images from their site and use it on my site?

    Well I don't have a very good knowledge of the amazone terms of service but I think it might not be all that legal well I might be wrong. I actually have a promotional website that is all about amazone products and I even have an amazone store and I am part of their associate program so I just use their images and stuff.

    But i am not very much verse with their terms. Now that you ask I think i will have to go and give it a look.

    i have amazon sites for a while now and i have images that are linking to Amazon.com and i have not had any problems, i don't think you will have problems

      They don't necessarily have to be links to Amazon...more to enhance the content.

        If you pull images from Amazon, you can only use them to promote Amazon.

        Anything else and you're choosing to operate on the "it's easier to ask forgiveness than permission" doctrine, which could get expensive...

          John, I am going to disagree. But only to clarify a legal issue because you're conceptually right in helping others avoid legal problems.

          Where do the images on Amazon come from?

          1) Manufacturers
          2) Sellers such as you and I posting our products
          3) Amazon took the picture itself

          Except for category 3 the copyright issue is not controlled by Amazon. Doesn't matter what TOS they put on their website.

          Here's a real example: I once sold my super terrific book "Sue Your Boss" on Amazon and uploaded a cover picture for the product page.

          If you copied that picture and put it on your website (hopefully to promote my book!) Amazon cannot sue you for copyright infringement. But I could. Amazon only has an obvious license and consent from me for that picture to be on Amazon.com. But that does not transfer my copyright to Amazon. That enables me to remove my book, and picture, from Amazon.

          Hopefully that sense.

          Also, there is a difference between copying an image to put on your website and 'hot linking' an image from Amazon for your site. I'm not sure if 'hot linking' is the right word.

          Using Amazon's bandwidth to show a picture on your website could be a problem per Amazon's TOS.

          (Wonder if Google has "express written consent" from Amazon of for its robots to mine Amazon for data to show on its search listings?)

            Brian, thanks for the clarification...

            Seems like the bottom line is similar - you can't use an image without the permission of the rights owner. Correct?

            So where should you go if you need product pics for a review site? Straight from the manufacturer?

    Once you sign up for the Associate program, there is language in the affiliate contract giving you permission to use the images, so long as they direct traffic back to Amazon or support links which direct traffic back to Amazon.

    I agree with Timothy....Furthermore, the reality is that over the years that I've been creating Amazon review sites as well as working with others, there has NEVER been a problem with using product images from Amazon.

    Amazon is more aggressive in going after affiliates who use product brands/trademarks in their TLD's so just make sure you don't do that!

    I'd go to the manufacturer and ask for permission.

    If you are selling their stuff, I don't see why they would not give permission.

      Just because you haven't been caught yet does not mean that is "should" be safe to do it. :rolleyes:

    I see that if you are promoting an amazon product then it is fine :-)

    Its like a car salesman trying to sell a car without being able to show a picture of it....lol
