    The registrar still gives the owner of the domain a week or two to re-register, so it is "pending".

    All you can do is put in a name drop request for it if it drops i.e. does not get re-registered by the owner, it is yours.

    It's not always available right away.
    NameCheap gives 27 days to re-register for a regular fee. If you miss that then you have about 3 months to get the domain back but for $200 roughly. Later they decide what to do with it, possibly it will be auctioned off if it has a value.
