Semi Threatening Emails From Ebay And Efax.com Regarding Domain Registration

Well here's the story.. About a week ago I ordered some niche adsense sites to be built for me, from right here in the WF.

The keywords were delivered to me and I was instructed which domain names to buy.. 2 of these were efaxfree.org and ebayautoparts.org

Naturally, I got emails back from both companies saying this is our trademark name, please relinquish ownership, or we will take legal action.. blah blah blah you get the story..

But anyway, I was just curious if this has happened to anyone else, and if I should play ball with them or just ignore it.. Will they actually go after me for this kind of thing or is it just big talk?

Thanks~

Disclaimer: I am not an attorney and don't take this as legal advice.

Yes, there's been many cases of large corporations going after people because they have their trademarked name in a domain name. Personally I would just drop it, especially the eBay one.

The efax you could argue that "efax" is a general term these days, but again, is it worth it?

BTW, you're allowed to have trademarked names as an extension to your URL, such as domain.com/ebay, but not as part of the top level domain.

    Play ball?

Well, you are using trademarked terms in your website domain names so all you should do know is forget about them and give them up. Nothing else good can come of this.

You made a mistake, now you realize it. Just move on and don't use trademarks in your domain names again. Ebay is real big on cracking down on this as it's their business.

Copyright infringement is against the law. What ball are you asking if you should play with?

Yes... play ball. eBay cracks the whip on everybody who registers a domain with their name in it. They got me around 9 years ago.

Let 'em drop and move on.

I understand the ebay warning is automatically sent to any newly registered domain containing ebay, even a site like TheBnBbyTheBay.com

The first visitor to a new domain of mine containing iPad was from a security service that works for companies and government agencies, (sorry I don't recall their name right now,) they are known to do tricky things like blind probing common admin directory paths, monitoring chat logs, etc. I have to assume the trademark term in the name attracted the visits from 2 different IPs used by this agency.

You had better play ball because ebay has the power to smack you out of the ball park!

I wouldn't even think of messing around with them....
