Someone Posted My Ebook On Amazon!

So I thought I would post one of my free ebooks on the Amazon Kindle store.

I do a search for the title and what do I find... my ebook has already been posted on Amazon by some little opportunist!

Anyone ever have any luck getting your work that's been posted by someone else taken off of Amazon? Is it even worth it to try? They are selling it for $2.99.

Maybe I'll post it there with a lower price. It is available for free elsewhere but I wanted to put it on Amazon for the exposure. Maybe this person is doing me a favor.

    If the uploader didn't modify the ebook then he is surely promoting it for you. But I would prefer to take it down from and through Amazon because there is a chance that same person might keep an eye on your ebooks and products and sell them like this because he never faces any problem. Taking down is a better option.

    Buy it and check it out before you go off the deep end.

    Maybe the book is actually different with the same title as yours??? Just in case.

    If you find that it is the same and nothing has been changed and you have links to
    your related products/sites then Thank Him/Her...lol

      Here's a twist: Why not use this to further your brand? Since Amazon lets used book sellers list right next to the original publishers, why not list your own, insisting that it's the original, in pristine condition -- not a used, dog-eared and musty ebook selling at a lower price. Then send out a press release about it.

    Nope, it's a free ebook written by me that I give away in return for opt ins. Definitely not PLR.

    Nope, definitely mine, he even scraped some of the content from the ebook and used it in the description. Also used my e-cover image.

    You know, I was just thinking of doing that. I might put my own listing up and add something like, "Official Author Listing" in the title. Then go on to emphasize the fact that this is really my ebook and any other listing is totally bogus and should be ignored.

    I'll go ahead and contact Amazon about it but it's not that big a deal as it's basically a promotional tool for my other paid ebooks. Still irritates me that people do this. I found another popular ebook in the same niche for sale, obviously not from the true author.

    That's very unethical for anyone to do this to you, stealing intellectual property rights is one of the most common problem nowadays. As long as you can show evidence to Amazon that you are the real author and this person is stealing your works,I'm sure you can win this battle. Keep us update wt the outcome

      Copyright laws implicitly reserve TO THE AUTHOR any rights NOT EXPLICITLY GRANTED otherwise. It's not the other way around.

      That's a great question, Neil. But my understanding is that he doesn't have to say anything about permissions if he isn't offering any. The assumption should be that no permissions are granted, UNLESS otherwise stated.

      Also, a copyright exists once a work is in fixed form.

      However, I am not a lawyer, but that's how I've always viewed such situations.

      I do get what you're saying though, and it's probably not a bad to make it very clear what rights people have or don't have.

        What do you suppose would happen if you posted a copy of Stephen King's latest novel, in ebook format, for sale on Amazon, claiming that since the original ebook version didn't "make it very clear what rights people have", and didn't specifically state you couldn't post copies of it for sale online, that you just assumed it was OK for you to post it for sale yourself, and not have to pay royalties to King?

          That's in full agreement with the first part of my post.

          The assumption should be that no permissions are granted, UNLESS otherwise stated.

          Surely a better way would be to get it taken down, and then upload it so that the OP gets the 2.99 as well as the leads and any other benefits that accrue.

          People republish articles without the correct attribution all the time - and pirates take your work and put it up for free on download sites all the time. But the brazenness of taking something and turning it into a Kindle Book - if it were me I'd be in touch with Amazon straight away and get that guy banned.

    Not only is it annoying, but it is also a copyright infringement. You could go for the big bucks in a court case. That is, if you registered your copyright. Otherwise you probably can't win. Amazon will take it down with notice.

    I'm sorry to hear about what happened. I'm sure that if you provide some proof to Amazon, they'll act swiftly in removing that pirated ebook from the Kindle store. Let us know what their response is.

    I'd try to get it taken down simply for the fact that if you don't this guy is going to do it again and again. And even if you do get it taken down, he will probably go find another free ebook to try to make a buck off of. I hate people sometimes.

    I actually submitted all the required documentation to Amazon via email and called someone over there who told me what to submit... and it's still up there.

    I emailed them again and no response. It's really not worth the effort to me to take it to the next level.

    I've since submitted a Kindle version of the ebook at a lower price.

    A Google search on the title shows the actual PDF file first, followed by my listing for the book, and then his listing is third. It does irritate me though that Amazon is ignoring my further attempts to have the listing removed.

    Amazon is pushing to expand their dominance of online ecommerce. They are pushing at clickbank by allowing anyone to sell ebooks and digital products. They are pushing at eBay by allowing people to list one-off used items. And they are making it very attractive to sellers by offering a built-in 'pick and pack' service with no minimum stock.

    Unfortunately, Amazon has also started to get a reputation for avoiding issues if the resolving the issue would cost them money. You are not the first person to complain of bogus items and sellers remaining active on Amazon long after a complaint and follow-up have been made.

    Although, it must be tough policing that kind of stuff for Amazon. They could do a better job of shutting down sellers more quickly once the facts are clear.

    That really sucks. I published a book through Wiley in 2005 and we ran into that problem recently. Fortunately Amazon responded (but it take a bit to get it taken down).

    I'm pretty sure Amazon doesn't want ebooks listed that are for sale for less elsewhere. My understanding is that they'll reduce the price of a book to below the price it is listed for on another site. That's why they have a link on the page for every ebook that says "tell us about a lower price." Granted, it would be a way to get the thief's copy's price reduced to zero but you could be similarly penalized if you posted the book - for anything more than free.
