Image EXPERTS -I Need HELP!

A buddy and I got to talking the other day and he asked me about publishing something online.

The question with images is this...

The publication will be a preview of the NFL Draft.

What are the options when it comes to images?

Using generic stock images isn't an option...

And Getty Images @ $300 or $400 or $500 per image is also not an option.

Even AP Images is $300 or so for "editorial use" of a photo like these from last year's draft -http://www.apimages.com/Search.aspx?st=shwc&xslt=scssr&id=355564#Close

So what are the options...???

There have to be public relations photos out there for these athletes from the University they play for, right?

What about a photo like this, for example?

Ryan Mallett - University of Arkansas Athletics

It's just a profile picture of Arkansas QB Ryan Mallett, who will be drafted this April.

Any idea if these images are okay to use in a magazine or report that will be sold?

Where do all these websites and such get the images they use???

They can't all be paying $300 or more for each image can they???

Are many of them just using these images illegally?

Any idea where to find more info about this?

I know it's a different question then often seen here....but I appreciate anyone who is able to help and educate me.

THANKS!!!!

Unless you own the image or took it yourself then no, you can't use that image in anything you publish whether it be online or off. Why do you think places like Getty images are able to charge so much per photograph - because they know they can.

You can bet websites doing things legally would have bought the rights to the relevant images they are using - if they haven't they are breaking the law and risk legal action being taken against them at any time. I know Getty images has a legal department thats sole job is to sit there and look for copyright infringers all day long. It's not a matter of IF you will get caught, but WHEN.

The law is fairly simple. If you want to use those images you will need to pay the fee, if you don't then you are breaking copyright law.

      Will,

I obviously understand the law....that is why I'm asking the question.

We're not talking about the usual "internet marketing" stuff here, though.

These Universities have public/media relations departments whose sole responsibility is to deal with media and promote their school's sports programs and players.

Perhaps your site can be designed such that artistic rendering of players likenesses fit in and mat even add to the perceived originality of the site. I assume a court reporter style rendering would not be subject to copyright issues, though you can find cases of drawings of photos discussed.

Would a $5 per image cost work?, employing Fiverr talent, take care a photoshop stylied copy of a photo is not an original piece.

Yes, you could go and get some caricatures made of those sports people and use those images instead. Here are a whole lot of caricatures of sports people:

Caricatures from photos : Create personalized caricature online

Why not try contacting the person for some photos of himself?. Tell him/her you're creating a fan site and would like to add a personal story along with some personal photos. This way you are clear of all legal issues and probably get an autographed photo just for developing a fan site for him/her.

I appreciate your attempt to help, but apparently you do not understand what it is I'm trying to actually do here.

      Caricatures definitely wouldn't work here.

Contacting every player that is going to be potentially drafted in the NFL Draft...???

Again, I appreciate the help, but you must have misunderstood what I'm trying to do...I'm not creating a "fan site".

No worries though...I've sent out a few emails to several media relations directors at Universities around the country. My potential business partner and I have a few connections in Division 1 college football and they gave us some people to ask to find out the REAL answer.

      Ed,
These 'soon-to-be-overpaid-jocks' are represented by Sports Agents.

The player you named appears to be represented by David Dunn of the sports agency Athletes First.

It just took me 30 secs on G00gle to find that out - search 'athlete-name+represented by' (I didn't use the punctuation...)

I imagine it would be in the interest of the agent to gain publicity for the athlete(s) they represent. Ask permission to use their photos...

      Go get 'em!

Yeah, tried the whole agent thing. No luck.

Most agents and agencies are a little busy this time of year and don't seem to respond to requests from little guys like myself.

Not looking for action shots or anything....just need a "headshot".

The NFL also will snap these types of photos of these guys here at the Draft Combine in Indianapolis in a few days...I've emailed their media relations people as well.

Don't think I'm one of these people who just ran to the WarriorForum and asked the question...I've been looking for answers to this for a few days.

Just thought someone here might have an answer....doesn't look like it.
