Music Question? Animoto and OneTrue Media - Anyone have concerns w/Commercial License?

As one who has done web sites for local businesses and schools for a number of years, I have always had to be very careful about the images I use, as I am selling the site to them as a whole, meaning they then own it so there can't be any copyright issues. (I always burn them a hard copy in case I get hit by a meteor...or bad movie)

It's the music that concerns me...if you don't use the 'commercial' or business license, (especially with youtube's TOS) for repercussions? Maybe I am am confusing the service of creating the video, vs selling the end result to the client?

Just tossing it out there....not my forte (music), but I am very curious...

    I'm not a lawyer, but I do have some experience with music licensing. What are your concerns exactly?

    If you are using royalty free music from a Library then you probably have usage terms similar to that which you are used to with graphics. As long as you can transfer the rights and you are only selling to one person then you are fine.

    If you are using commercial music in the video you need to get what is called a synchronisation license from both the master rights holder (represents the performer of the track), and the publisher (represents the songwriter).

    Just had a look at the actual services you mentioned in the subject line:

    Animoto have a commercial section which features just the tracks that are available for commercial. It looks like this includes a lot of classical music which could be out of copyright anyway.

    One True Media has a very clear policy in the T&Cs that it is for non-commercial use only.

      I will throw something that happened to me recently regarding Animoto and YouTube...

      I've been using the Animoto Commercial account since day 1 of the offering. It provides what they call "hassle free" rights to a library of artists songs that you can use in your commercial projects.

      I got notified by YouTube that I was in violation of copyright for one of my Animoto videos music track in that RumbleFish had claimed copyright.

      RumbleFish didn't "object" to my video being up there...but because of the complaint, they get all Views credit unless I dispute the claim...

      I have a support ticket into Animoto to see what's up...

      While the original classic music is maybe out of copyright, the orchestra that plays the music has a right on their performance and that is under copyright protection.

        I assumed because Animoto offer a commerical package they had already cleared those rights... but, from what LonNaylor says it appears they may not have cleared full usage rights.
