California Clickbank Affiliates Next?

Besides Amazon, here's an email I got from a Shareasale merchant:

Dear NetEzShop,

Governor Brown of California signed a bill yesterday that unfortunately requires us to end our partnerships with California-based affiliates. CSN Stores has no physical presence in the state of California but the new law expands the meaning of "physical presence" beyond a warehouse, factory or office to include affiliate relationships.

We are opposed to this legislation because it is unconstitutional and futile. We deeply regret the action we are being forced to take because of this law.

Since the law is effective immediately, contracts with all California affiliates in the CSN Stores Affiliate Program will end today and you will no longer receive commissions on sales.

You are receiving this email because our records indicate that you are a resident of California. If you relocate to another state, please reapply to our program in ShareaSale.

The California tax law only affects our ability to work with affiliates in the state of California. It does not impact California residents who purchase online at CSNStores.com or any of our online stores.

We have enjoyed working with you and our other California-based affiliates, and if this law ever ceases to exist or is amended to exempt affiliate partnerships we would be happy to work with you again.

    From what I've read, this will only effect sales of physical products; it won't effect digital goods. However, this is only what I've read in another WF thread.

    Right now the California sales tax law does not affect ClickBank because it only taxes the sale of tangible products. Not digital downloads.

    That is not to say California isn't looking into additional products and services to levy a sales tax on. But I imagine digital downloads is far down on the list of potential revenue "enhancers".

      ClickBank currently allows the sale of shippable media products. Wouldn't that be considered a tangible product?

      The nexus tax law was just narrowly defeated by the Louisiana legislature in a very close margin, but they're going to keep trying to get it passed.

        Hi,

        Wow, that's scary. It seems more and more companies are letting the lack of taxes force them out of local markets. Amazon will not accept affiliates in North Carolina either. So far I'm in a good state - Indiana.

    kindsvater, is it possible to establish "dual residency" in two different states? One being a non "Amazon Law" state.

    What about having a (trusted) relative sign up for an Amazon account from a "safe" state?

    How much "due diligence" is Amazon required to verify residency/address information if you provide them new address data outside of California?

    I am sure there are 25,000 other CA Amazon affiliates thinking the same thing.

    How about setting up a cheap corporation in another state, say Nevada. Does clickbank etc. allow corporations to sign up?

    we could check out "mailing forward service" on google. 20 bucks a month ?
    a relative maybe can do it for free or cheaper.


    My mother get mail from a lady that is in a retirement home and they are all labeled "forward" to my mother's address. FREE but Im not sure what the USPO rules are on this...

    If this could be done then maybe that the direction we can look into.

    Wow ...it is bad enough that I can't sell Amazon products anymore because I live in CA and now I might be getting booted from Clickbank? This is ridiculous ...Jerry Brown is doing more harm than good, just like most politicians.

    Is there any way around this if it does happen?
