Legality of offering discounts on affiliate programs (eBooks/software)

I was wondering if it is legal to give discounts if your an affiliate of an eBook without asking permission from the owner.

For example, if I owned a database of Clickbank products could I offer 10% back on all products after the 60 day trial period (to avoid chargebacks). Is this against Clickbank's TOS or any California laws?

PS: sorry if my english isn't as good as usual. I had a lil too much to drink tonight. Celebrating because I got my first 3 clients (for SEO) today out of nowhere.

    I believe the affiliate programs usually forbid offering cash incentives, but you can offer bonuses, the biggest affiliates of big product roll-outs might offer bonuses "valued" at more than the main product.

      Clickbank specifically will not allow INCENTIVIZED traffic. How do I know this? I talked with them as my partner and I are about to launch a cash back shopping site centered in IM products. I emailed them and specifically asked them and they will not allow ANY of this. If they find out, they will cancel your account and void your commissions earned.

      You CAN do this sort of thing, BUT you need either to have products from a network that allows this (*you need to check TOS or ask) OR if you go directly to the vendor, you need to disclose to them as well. They really shouldn't care and if they DO, they are the ones missing out on sales.

      Have fun...it was for us to get started, BUT I have 180+ products going into our site this week and then about 200 or so in the next few weeks once some tracking is updated with that network.

    I don't understand what you mean by "owning a database of ClickBank products", but it seems that what you're asking about is clearly against ClickBank's TOS.

    It's explained here: ("Don’t offer bonuses of cash or cash equivalents (such as gift cards) for customers who purchase a product through your HopLink. This is not allowed in ClickBank’s Client Contract.")

    I don't understand what you mean by "incentivized traffic", Charles. The same ClickBank page linked to above states clearly: "You can, however, offer other types of bonuses, such as additional ebooks or related products, to customers who purchase through your HopLink." In what sense are those not "incentives"?

    It seems pretty unambiguous to me, I must say: you can't offer money or anything directly equivalent to money, but you can offer incentives. It's there in black and white.
