Just Nailed A ****Weasel Selling My Stuff On Fiverr

Cool, he was selling it when a customer alerted me to it:

Fiverr

He was also selling other products that don't belong to him

Ironically, the stuff he was selling was old and outdated (contrary to his claims), the crack to it plugged in a trojan so he wasn't only screwing me, but his customers as well. Go figure...

Although it took a day of back and forth email to sort out the legal details, the guy that helped me, Ryan, was quick to act on it on his end, once he had credible info on copyright ownership.

I'm glad to see that Fiverr has a fairly rapid response to issues like these.

        That won't work. He already has at least one copy of your products. When his first customer alerts him that he can't download it, he will put it up on a file sharing site like Rapid Share or Mediafire and insert the new link in his offer. He can repeat this as many times as you find his link, and have it deleted. All he has to do is to rename the zip file he uploads to the file sharing sites.

        Your best option is to try to get him banned from Fiverr.

    I'm not sure this is favorable for Fiverr.

    There is no reason why they should have required you to prove copyright ownership.

    The title of that Fiverr offer, by itself, should have resulted in an immediate nuking of the Fiverr account with a complaint to PayPal. (Which I hope you also did).

    Wouldn't it be nice if a service simply deleted garbage, "cracks", and other illegal conduct, instead of making money off of it until the actual product owner discovered what was happening, complained, and had to jump through hoops to prove their ownership?

      Once that was resolved I sent in another request on behalf of the other product owners stating, "To go on record that you've been advised of copyright infringement....blah, blah, blah."

      Interestingly enough, they then took down all the gigs this guy had.

      I will be talking with PayPal on Monday (I've got an account manager to deal with this) as the seller is actually Fiverr (feedback@fiverr.com). I purchased a copy of it to confirm that they were our products, cracked etc., before reporting him.

      The other open issue is dealing with the buyers, who, from the first comment left, seemed to understand it was an illegal offer and purchased it anyways.

    Full marks to Fiverr, Glad you got it sorted BIG Mike. I detest people who can't get off their A** and produce anything of worth. Instead they have to steal other people's stuff. I call them parasites..

    I wish I had the problem of people reselling my stuff on OTHER websites. Unfortunately my biggest problem is the idiots continually trying to sell parts of my products on THIS very website...

    It's good that we can all keep an eye out for each other. Just today I noticed someone else's WSO being sold on fiverr so I alerted them also.

    When people are frightened, stressed-out or generally at their wits end (for any number of reasons) they tend to be more inclined to act in ways that we consider unethical, illegal, immoral, or down-right stupid. It's human nature. And with the economy as it is, and so many people struggling to make ends meet, there are more people then ever prepared to act in the ways I just explained. Sad but true. And while I don't condone the actions, and frankly find it a royal pain in the rear to deal with too - I try and remember this when it happens to me. Just my 2 cents.

      I hate those little scammers. Not because they`re immoral, but because they`re losers. One guy was SELLING my free report on a different forum. It`s like 10 pages, what he couldn`t write his own? Loser! :rolleyes:

      Only if they were raised in that way; i.e. if they didn't get a solid foundation of basic values in the family.

        Yes I agree "upbringing" has its place, but at the core we are basically hard-wired a certain way. Stress affects each of us differently.

        For example, the single parent who's lost their job and can't find another quickly, who gets no support from home (regardless of upbringing) and is running of 'financial fumes' is likely to get real basic in their behaviours - real quick.

        Like I said, I don't condone it, and I'll act on it when I see it - but I do try and understand it.

          Guess I'm lucky. We're not a land of plenty, but we simply have enough for everyone. There is no need to steal for food and clothes. Work for it or just ask for it.

          But some chose to steal.

          We do have silly kids who steal for fun and excitement. They even rob 7-11s just to buy better mobile phones, video games and to pimp their rides. Drug addicts steal and rob, to get their daily fix. We also have many cases of gangs crossing our borders to steal and rob, competing against local gangs. And we have scams and credit card clonings. And we have daylight robberies in the millions by several big fish.

          None of them are about food. All of them chose to be thieves. It is lucrative.

          The same thing for online thieves.

          They know what we are - "The Move On Type of People Who Do Not Waste Time To Deal With Their Illegal Activities.". That's why they have been getting away with it for a very,very long time and expanding it further ... far and wide. We "move on", they move on even faster.

          And what Mike and Rus did is just awesome. Stop them cold.

      ive have always had problems with people getting my software cracked and passing it around or reselling. real irritating some times. for you guys who cant lock your stuff, it must be a real night mare. On the flip side
      my partner and i joke around, we say things like, its not how many copies we
      sell that determines if the software was a success, but rather how fast it hits the black market....

        So true. I just feel a little sad for these folks, if all they can do is knock-off and copy us, they'll always be lagging behind picking up scraps. If you believe in the idea it's better to focus on positive action than chasing these guys and "funding the frustration" then you'll be happier, healthier and wealthier for it

    I caught some douche reselling gpscraper for 5 bucks on Fiverr! 5 bucks for a $349 software application that's mine! The thing is not only was he screwing me but he was also screwing any person who bought my software because the version he was selling doesn't work any longer.

    I sent a DCMA notice to Fiverr and his gig was down that same day too!

    I'm constantly writing DMCA letters to Torrent sites etc.

    Infact it's happening to me that much, I've now got a fill-in-the-blanks DMCA letter in notepad.

    I have caught two people selling my products on Fiverr and two people selling my products as their own WSOs here. They were all taken down fairly quickly. One of the Fiverr guys moved over to Digital Point and started selling the product there. DP never responded to my DMCA notice and left the thred open. I finally got it removed when I found out the address of the thief. Let' just say that I can get nasty when it's necessary

    Sometimes buying crack software is better because I just got an email from Incansoft@gmail.com refusing to give me updates and support because I complained about the SPAM-MAIL they were sending.

    They said it's against Incansoft TOS to complain about receiving spam mail. Here's the email they sent:

    you have violated our terms of use, so you are no longer eligible for support or further communication from us. All other email from you will be marked as spam.
    It's a sad, sad world we live in. I just spend over $80 on Incansoft software the last 3 months, and now I don't get any support or updates.

      Apparently unwilling to stop at a state-level crime, gearmonkey appears to have no reservations about announcing a willingness to dial it up to the point where it could morph into a federal crime. This sort of vitriol can be used to show a criminal lack of restraint and an attitude of "Do what I want -- or else." It easily can be used to paint a picture of an extortion or blackmail bid.

      P.S. When folks display a lack of personal restraint to this degree, it could morph into cyberstalking and an organized smear campaign across multiple platforms. Such things have happened on social-media sites. In the context of IM, such incidents raise the costs of doing business online and force companies to devote resources to putting out fires they didn't start. There is no justification for it in any context. In short, the customer is not always right -- and it's not rare in IM for vendors to be subjected to extortion bids, subtle or "in your face."

    Big Mike just proved how they are SPAMMING emails and, if you complain, refuse support and updates.

    I gave them over $80 of my hard earned cash the past few months and this is how they treat paying customers?

    I didn't give them my money to SPAM my email account with crap mail. I just wanted to buy their software to grow my business. Instead, I get this crap.

    That's not very professional at all. And it's sad.

    Live and learn, I guess. I'm only out $80... But I could have used that money to buy useful software from a reputable company.

    EDIT:

    I asked them several times to stop emailing me SPAM mail. I didn't unsubscribe because I paid for software that, like all SEO software, needs periodic updates. Why pay $80+ for outdated software?

        I purchased and gave them my private, personal information in good faith. Now I am suffering because they want to SPAM my email box daily.

        I asked them repeatedly to stop emailing spam. Once I threaten to take this to the next level, to show them how unprofessional they are, they respond with:

        you have violated our terms of use, so you are no longer eligible for support or further communication from us. All other email from you will be marked as spam.
        Maybe I handled this in a brute force way to get my point across. Still no reason to treat a paying customer like this.

            I can take screen shots of a spam email from incansoft@gmail on the 9/15 and another spam email from incansoft@gmail on 9/16.

            Be professional and make a different support email from your spam email. Problem solved.

        Here is our policy from Incansoft:

        We respect our customers and work hard to provide prompt, courteous support to them. Customers who submit threatening, abusive or harrassing support requests will immediately forfeit their right to Technical Support from Incansoft.

        We have this policy in place for situations just like guy who's email I posted. He's been emailing and harassing our support staff, threatened to cause us injury by having us bombed with spam (which he did - the spam folder exploded this afternoon).

        I've got two really great support techs full time and I'm not losing them because of people like the GuitarMonkey. Difficult customers are one thing - this is completely different.

    Had I known that the stipulation was SPAM-MAIL with every purchase of software, I would have given my money to a reputable company with standards.

    I didn't sign up to the SPAM-MAIL, I only wanted to buy functional software with good support to grow my business.

    Boy, if hindsight was 20/20.

    As for harassing your employees, you harass me everytime you blast your spam. I emailed support and asked you to stop, instead of "Okay, sorry, we won't spam you anymore", I get MORE SPAM!!!.

      If so, your posts here on this topic are demonstrably false accusations made with the intent of harming a seller on inaccurate bases. Want to guess how long the ban is for that when we have this kind of proof?

          I'm the moderator who's asking you a question that will determine how long I ban you from this forum.

          The email Mike pasted in has a very clear option for unsubscribing from the general announcement list and getting only emails related to Incansoft products. Updates are also available through the products themselves, which makes your arguments spurious. And it's not even remotely unusual for someone to notify customers about other products they think might be of interest. Not all sellers do it, but it's pretty common.

          This dispute was none of the forum's business until you came charging in here making unfounded allegations. You've been a member long enough to know about Rule #1.

          The innuendo about dealing with "reputable" companies instead was just more depth to the hole you're digging.

            It is realated to WarriorForum because the spam link in the spam mail is to WarrirorForum WSO forum. It's a direct link to Warriorforum.

            So yes it is related.

            I asked incansoft to stop sending me spam mail. It was asked several times. They responded with more spam.

            They spammed twice the last two days. I gave them my hard earned money and my private information and they are abusing it.

            I have purchased lots of products from WSO and incansoft are the only ones spamming me. I don't get spam mail from other sellers (at least not yet).

              Chances are it isn't a direct link but I think you're too full of hate and rage right now to really hear what anyone is saying. Chances are it was an affiliate link.

              Are you really freaking out because someone sent you a few emails that you had the option of ignoring or deleting? I can forward you some real spam if you want to take a look at what spam looks like in your inbox.

      Then maybe you should read our Privacy Policy, which was written by a lawyer:

      I too use email marketing, but I don't spam people daily, or send email to them when they requested to be taken off the list.

      The un-subscribe button is at the bottom, but I didn't see it. I emailed support personally and asked them to remove me, not once, not twice, but several times.

      Isn't a simple email to support suffice to be removed from their spam list?

      I'm not bashing anyone. I'm am disappointed right now because I feel like sending multiple requests to their support to remove me from their spam list would be suffice.

      Big Mike says I accepted their spam mail when I signed up, but I did ask them to stop spamming me several times.

      Why can't they make a separate email for their "sales" promos from their support email. I purchased this software in good faith. I gave them my money. Now they refuse to give support even though I requested they remove me from their mailing list.

    Hate it when a thread gets hijacked like this. Originally it was about nailing a weasel who had stolen original work. Again, congrats on nailing him/her. I'm a sincere advocate of writing original content, and I spend time on my content. If it's sold as a PLR and they tweak it, I've given them the right to do so. There is no other content I write that should be copied. Period.

    And by the way, I'm very glad there are active moderators on this forum. Thank you from a relative newbie here.

    Wow. This is just precious. Is it bad that I found this whole drama thing entertaining?

    Paul and Mike, it's too bad that you had to deal with this...unusual person, but you both did so in a very professional way. Kudos to both of you.

    Maybe GM was having a bad day...maybe they just ran out of bail-out money.

    I wonder if other people get this upset about getting promotional emails instead of the updates they expect.
