Don't Make This Mistake when Registering Your Domain

In Britain, during the second world war, the phrase ‘Keep calm and carry on’ was printed on posters that were displayed everywhere. The government of the day did this as a means of helping the population to keep its spirits up. In today’s challenging economic climate, it seems that the phrase has become popular again and a number of enterprising small businesses here in the UK have been selling T shirts, coffee mugs, cushions, tea towels and a whole range of other products bearing this catchy slogan.

But today, I heard that the European body responsible for trademark registration has allowed one of these small businesses to trademark the phrase. So that means anyone printing this phrase on their own products is now in breach of European law and could therefore now be facing legal suits if they fail to stop selling such products. It seems perfectly legal, provided that a particular phrase has not already been trademarked, to do so as a tactic to knock a competitor out of the market. Quite an amazing situation isn’t it?

Many people can fall foul of trademark law by registering domains that make use of trademarked terms. There was a case a few years back in which some individual was forced to release a domain he had registered because it contained the phrase ‘think and grow rich’. His defence was that the book ‘Think and Grow Rich’ by Napoleon Hill was now in the public domain and, although that is indeed true, he still lost the case because the organisation that had allowed copyright to expire still held the trademark.

Here are some more examples of phrases that are ‘owned’ as trademarks:
  • I’m lovin it
  • Because you’re worth it
  • It does what it says on the tin

A short while back, I heard that Facebook had been granted permission to trademark to the work ‘face’ when used within certain contexts.

So do be careful when registering domain names. You could quite easily spend a considerable amount of time and effort in building a site only to fall foul of the law and be forced to give up your domain.

      Interesting case, Will.

      This is a classic example of "It's not over until the fat lady sings."

      This particular Trademark should never have been granted and most likely will be revoked in the near future. It may also prove to be a financial burden to the company that was granted the Trademark.

      They are currently interfering with existing companies who are selling items using that phrase and will no doubt be liable for business losses incurred by the companies who it is currently seeking injunctions against for using that phrase.

      One of the other lessons here is to be aware of the backlash that may result as a result of trying to 'get one over' by relying on the ineptness of a regulatory agency such as appears to be the case here.

      Those folks knew they were pushing the boundries by trying to Trademark that phrase. They are not innocent of any wrongdoings should that Trademark be deemed null.

      Time will tell...

      Uh-oh. That has Facebook undertones. Plus, I think they actually trademarked the word "like" too.

      Maybe something like "I admire this to the fullest extent" would be more appropriate? Or "I approve of this fine thread". Even "I delight in your words of wisdom".

      I might even say "I dig it, bro!" I don't think that is trademarked yet. Just having some fun. haha

    It'd be convenient if there was a way to check if a phrase or a word is trademarked. But is there any?

      You can search here: Trademark Electronic Search System (TESS)

      ...but I don't know how useful it is, or if the results are reliable if no trademark turns up. There are lawyers that specialize in trademark seaches, and I would guess that would give you a lot more assurance and perhaps more legal protection.

        Actually there are companies that specialize in trademark searches - and they are a lot less expensive than a lawyer if you don't trust your own search capabilities. They even give you trademarks that are close enough to be possible infringement dispute risks. Just check your phone book yellow pages for "trademark" and you'll find search companies if there are any around you. I'm sure there are some online by now, as well, but then you have the added job of some due diligence.

    Even the phrase "Let's get ready to rumble" used by boxing ring announcer Michael Buffer is trademarked.

    If in the distant future all words in the dictionary are trademarked, does it mean that you have to shut it up just to avoid a lawsuit?

    i remember registering a domain to help local realtors with local seo - i had a cease and desist less than 4 days later! lol

    glad i hadn't built the site at the time and was marketing it - at least they let me know right away i guess!
