Copyright Infringement! What do I do?

Hey Warriors,

Some a-hole is blatantly infringing on my copyright and pretty much just stealing my stuff for his site. He is selling a similar product...but just using all of my stuff.

What can I do? I would really like to get this scammer taken down...but just getting my stuff off of his site would suffice too.

Please help. I am pretty upset about this because I have worked my butt off for this...and this guy is now seeing quite a bit of success (stealing my customers) using my own stuff!

  • Can you send me links to the pages (yours and his) so I can take a look and help you figure out the best way to proceed? Thanks
  • Contact the site owner and request he link back to your site in all of the articles/posts, or remove them completely. If he doesn't, contact his webhost. They will remove the content.
  • What is it that he stole and is he selling it here? If he's hosted in the US, send his hosting company a DMCA. If you don't know who he hosts with, post the domain here and I will tell you the company.

    • do a whois lookup, send the registered domain hosting company an email.

      You may also want to contact a trademark/copyright attorney who can send an "official" scary cease and desist letter. Be prepared to follow through with lawsuit if they don't take it down.

  • I had this happen with 1 of my sites - an exact copy, the only thing changed was the affiliate links. Made me pretty mad too.

    Do a WHOIS check on the offending website, then get in touch with whoever is hosting it. You'll have a bit of paperwork to do, but the site will be taken down pretty quickly as long as you can show that yours was there first.

    Send a DMCA to the host.

  • First send him a DMCA take down notice. You can find an example here of one Example DMCA Notice of Copyright Infringement - FutureQuest, Inc.

    If you get no reply back do a whois request and find out who the person is hosting with. Send his host a DMCA take down request and if you are lucky they might take his site down.

    PS: Only do this if you can prove you are the rightfull owner of the copyrighted content.

    I do want to say though, if you pursue this, then you need to be fully prepared to take it to court and prove that you are the owner of the content.
