Embeding youtube vids

Hi guys. Just looking for some quick advice on a fairly simple question. Myself and my brother have recently decided on giving affiliate marketing a go. I personally have no experience on the subject but luckily my brother works for a SEO company and can pass on some of his knowledge to me as we progress. One website that we are working on atm will include product reviews. What I would like to do is embed relevant youtube videos to complement the review articles. Can someone tell me if this is allowed?? The issue I am having is, their is a certain vid that I would like to use but the video doesn't seem to have been created by the uploader. It actually looks like an advert created by the merchant I am looking to promote. I've looked to see if that merchant has a youtube channel but can't find one so don't know where this uploader got the vid from.

    I see that you are new to the Forum, so welcome , you'll get some great information here.

    What a great question you have asked. I'm sorry to say that I don't have a great answer for you, just a few random thoughts that might help.

    I'm tempted to say that yes you probably can embed the video that you wish to - but I'm not 100% sure of my position here. But here's my reasoning anyhow ...

    1. Presumably the place where you found the video, has set that particular video with the setting to allow it to be embedded. So if they are allowing it to be embedded, then it's fine for you to do so within the T&Cs of YouTube.
    2. If they are in breach of copyright by posting the video on YouTube in the first place, then the copyright owners would take issue with them directly, probably via YouTube.
    3. If it was found that there had been a breach of copyright, then it would be removed from the uploaders channel and action could be taken against them.
    4. I believe that there is an implication that anything that is embeddable from YouTube is deemed to be legitimate and that by embedding a video you do so in 'good faith'. If YouTube removed the video, then your link would simply no longer work.
    I'm not a lawyer, and I have given you what I consider to be a 'common sense' point of view.

    It's a very interesting point that you raise and I have a meeting scheduled for this friday with a media publishing lawyer, to discuss copyright issues and recourses with regard to video on the web. I'll raise the question with him - as long as he doesn't want to charge too much to give me an answer .

    If you are planning on doing affiliate marketing though, then the business whose product you are promoting would surely have banners, videos and other tools to help with affiliate promotions. Sign up as an affiliate with them (if you haven't done so already), see what tools they have for you and ask for more if you think you need better tools.

    If I get a good answer from the lawyer, I'll post it here.

      Hi digileaf, Thank you for your reply. I'd just like to be clear on my position. I currently have a website setup and is now live (although not ranked yet). I have an affiliate programme with casio and would like to review one of there watches. I'm almost certain that the video I'm interested in is a promotional video for the watch that I want to review but has been uploaded to youtube by someone other than casio. Common sense tells me that there shouldn't be a problem using the video to help make a sale for them. I just want to be absolutely sure before I go any further.

        If in doubt just contact casio via their affiliate site and see if they allow the use of the video, if the do I would upload it to your own YouTube account and embed it from there as you never know the other video may come down without notice.
