Guidance Needed: Images, Videos, Copyright, Fair Use, oh my!

Been reading about some of the youtube and / or poll methods for marketing. In none of the threads, have I seen anyone mention copyright.

Been trying to find answers, but still a bit unsure of somethings:

1) Video - Less than 30 seconds, used as news, criticism, parody should be okay?

2) Celebrity / Sports Figures / Actors / Politicians - Using their images for news, criticism, parody and making clear they do not support or endorse your endeavor should be okay?

3) The Images - Using google images to collect images to be placed on the poll or used in videos could be copyright violation if the collected image isn't royalty free to use? (Assume the images / video aren't being sold but part of an affiliate campaign)

a) I've seen the same image used on many different sites / blogs, could be free to use or just "too small" for anyone to care? Or to know about?

Basically I'm trying to figure out the legality of the poll method and of using youtube to drive traffic. Could you include a Statement on the site and/or video saying you do not own the images and if the owner feels their rights are being violated, you will remove upon request? I've seen some sites say written request in a legal sounding way.

Or since no one has mentioned being sued / that it violates copyright, it doesn't and I'm just worrying over nothing?

    Bottom line: if in doubt of whether it's legal to use someone else's video/image/music/writing, then don't, it's most likely not allowed or welcomed by that person. There are many sources of free images online that you can use without legal issue.

    Fair use is for, say, you are writing a paper comparing the poetry styles of two different poets on the same topic, and you use a snippet of a poem from each in your thesis. Fair use does not mean you can take the latest popular video and post a chunk of it on your blog to make money with it. That is a copyright violation. I've worked in intellectual property protection for years and had to deal with this alot. NOTE: I am not a lawyer and this is not free legal advice, but is based on my own experiences in the field.

    Hey, your experience is more than mine! So the input is welcomed. And I'm not planning to do that with a video, just trying to get my head on straight. Thought I read somewhere, that if you use a clip from TV or a Movie, you need to keep the clip under 30 seconds or youtube can / will remove it.

    The old adage, just because everyone else is doing it, doesn't make it legal.

    That's what has me confused, I haven't found any information on people ever mention this subject when discussing methods like the poll method that use images of famous people. So it leads me to believe maybe it is alright? Or just a so minor the owner of the images never see them or cares.

    Hmm.. whenever I've tried looking at free image sites, they usually don't have much content. Maybe I haven't looked at the right ones.

      hey alexander

      want my advice, dont take the risk, there are plenty of free sources whch allow you to use images/videos/music etc, there are also sources to use video/music/images royalty free and at a reasonable price. if you do use a image that is someone else depending on the company they could sue you for copyright, or they might just give you a warning first then take action.

      I wouldnt take the risk, just be safe then sorry.

    Thanks! Pain in the butt, wanting to play around and have some fun with this method, I see people claiming how quick and easy it is.. and I need to make it harder on myself by thinking it over like this, hahah. It is better that way.

    Do you know of any actual good sources? The free ones really have nothing worth using I've seen and the paid ones, it's too expensive for a fun project that may not generate anything.

    Thanks a ton Sue. And ouch, those two sites don't seem to really carry the niches I wanted to play in. The advanced google search, one of the niche terms brings up 170 million, use the advanced search, about 50.

    The White Hat approach can be a pain, but I'll manage somehow. Doing this doesn't seem as fun as before though lol.
