Do I have rights to the sales of this plugin?

I paid for a developer to make a plugin for the wp shopping cart I am using.

I just found out that now they are selling it to everyone (at a much cheaper price than what I paid). Do I have rights to the sales of this plugin? my web developer (who facilitated this sale) is acting like this happens all the time.

    I'm not a lawyer but i'm pretty sure if you didn't sign some type of agreement where you held 100% rights to this plug-in and no one else has re-sell rights, they can sell it.

    This is my opinion, but i believe im right.

    I would imagine it boils down to what was agreed. Did you pay for the rights for you to use this custom code? Did you buy the complete rights? Unless anything else was agreed the actual code 'may' belong to the developer. It's always best to iron the finer details out at the start.

    If nothing was outlined... And you have proof that you got the developer to create this plugin for you then technically you could probably also sell this product as there 'may' be 'too' much smoke to properly identify who has the rights. I 'may' be wrong here though. Just my opinion.

    The specific thing you want to ask for when having a plugin coded that you intend to sell is "transfer of copyright".

    By default, the person that writes the code owns the copyright to the code.

    So they need to explicitly sign over the copyright ownership to you in order for you to have full control.

    Generally speaking there would be an extra charge (usually substantial) for full copyright transfer.

    Otherwise, by using the code copyrighted to another person you are actually "licensing" it.

    wow, this was all facilitated by my web admin - he basically called us up and said "we can't do this thing you need for your website as-is, it'll be (X amount) extra for the coding" so we paid and he hired the people to do it. I wish someone would have informed me of this situation and what this actually was and that they could sell it, I'm really annoyed. I think this is more of a "web-admin told us as little as possible" thing.

    I didn't want this product to sell to other people, but I'm annoyed that I had to pay for the development of something that they're going to just make money off of additionally anyway and everyone else gets to use it for substantially less than what I paid.
