Anyone know the answer to this?

If I have an affiliate who is spamming people with links to my product, who is responsible legally? Me or the affiliate? I'm seeing some unusually high traffic coming in from one affiliate with no sales and my guess is that its Myspace Spam. I am waiting for feedback from the affiliate but I am curious how the law works in cases like this. Anyone know?
