I think I understand what you're asking, but how you've written it is all over map.

When you say that you want to "incorporate" this label what are you trying to say?

You want to form a corporation with the product being your proposed liquor brand?

You want to copyright the name and design?

If you have an idea for a liquor label/brand you've got two things going on here:

1. The name
2. The design/logo/brand mark of the label name

With both -- if original -- you will want to register with the U.S. Copyright office.

However, if you're starting this out within an American state, you'll want to go to your state's Secretary of State website and look in their section which deals with business names registered within the state.

Do a search to see if your name is available. If it is, you can reserve it.

Second, go to the U.S. Copyright site and also do a search for your proposed label name -- if successful, you'll find no result and your name is free. If that's the case, you have a few decisions to make about your business:

1. You'll probably want to register a domain name.

2. You'll want to reserve -- and get -- your proposed name with your state.

3. You'll want to start the process of copyrighting your logo and brand/label name with the U.S. Copyright Office.

4. Figure out your business form (corporation, LLC, partnership, owner, etc.).

Number "4" will determine a lot of the activities that you have to proceed with from there.
