FTC is coming down on unsubstantiated claims.

Here's a good example of why.

Here It Is...

  • Wow, pretty interesting.
Yea, basically, don't market rubbish. I try to market either products I have personally used myself and loved, particularly in the IM niche, or I will market physical products that just do a basic job like a coffee machine.
It's the products with the BIG claims and false hype that are going to get you in trouble.

I'm just wondering what the catch is that we actually needed another law besides the "truth in advertising" law we already had. Maybe Kindsvtar (did I spell that right?) can tell us. While I don't trust new laws like this at all - there are a lot of advertisers - like the one in Bill's link that really do deserved to get nailed. I'm sick to death of seeing products advertising get rich over night promises, too - and diet scams. Good grief, America is one of the top ranked countries now for unethical sales people. When you talk about world leaders, that's not exactly the category I'm real proud for us to be at the top of. lol.

I must have missed it because I didnt hear him say anything bad about the bow or how it didnt work. He said eating healthy and diet (not dieting) is the key. He didnt contradict the bowflex commercials.

KT, love him or hate him he is one hell of a marketer... Sure, his claims are wild but I don't pay attention to that. I pay close attention to how he talks, the way he pronounces his words and when he takes pauses...

I pay attention to the way he connects with his audience... That's gold!

          100% correct Mike.

I have an old Dan Kennedy marketing seminar ... and ... Dan goes from start to finish how Kevin crafts his offer.

          It is Brilliant.

Dude I never felt the need to register for an account here (I've been a long time reader though), till today when I read you talking about how Dan Kennedy has analyzed Kevin Trudeau in his Copywriting In A Box Seminar. I have gone through that seminar recording years ago but I don't remember that part. So today I tried to skim through it again to see if I can find it and I couldn't. So I opened an account just so I could ask you to help me out here and tell me where roughly Dan talkas about Kevin's pitch process in this seminar.

So ya... thank you in advance.

              hi blanketstar,

              Welcome to the forum.

Ya, being a 8 DVD set that's a lot of material to go through. I don't actually remember myself exactly where it is.

He was talking about Kevin Trudeau's infomercial structure and how they are basically the same. How it's so simple yet still very captivating.

I believe it was around the time he was talking about, P.A.S: Problem Agitate Solution and Star Story Solution.

                Thanks for trying Bill,

This Kevin Trudeau is just an A grade marketer. His story line is so nicely crafted, you'd start to fall for it if you keep listening to him. Last night I was reviewing his stuff to write some copy and ended up having night mares about secret societies and the end of the world all night.

Anyways dude if you ever figured where the part is I'd appreciate it if you could send me a PM.

                P.S. I just noticed you're a Torontonian... SICK...Me too! Where about's do you live?

          That is funny.

In one of his recent commercials, he is making the claim that the Federal Government is trying to stop him from talking about "free money from the government".

But the news story indicates that his ban from TV infomercials is for his "false claims about a weight loss program."

"As seen in TV" and "I am the guy the Feds are trying to stop" seem to be two of his marketing strategies, which seem to be very effective for him.

LOL.. those claims about the Feds trying to stop him are all true so I guess they can't nail him for lying or exaggerated claims on that one...

he's not banned from TV. He just can't promote his products on TV. Basically no more infomercials for Kevin.

There will always be snake oil salesman no matter what the FTC does. They've been around forever. You have to make the personal choice of how you want to market.

I don't know why... and this is just a hunch.

But I'm begining to think that the FTC doesn't like marketers. =]
Seriously though, they remind me of the NYC parking authority.

You can write tickets till the sun implodes and swallows planet earth.
Its still not stopping marketers. I mean illegal parking.

Nobody cares about marketers. The FTC doesn't like snake oil salesmen and companies that violate trade laws.

he got his shredded abs nearly ENTIRELY by eating well
Talk about taking something completely out of context.

He didn't get his "shredded abs" (as a collective) by eating well.

He first got abs by exercising (by whatever means) then he made them "shredded" i.e visible through fat reduction, by eating well...

The FTC will never come down on a fitness product just because a good looking guy can be seen using it in the commercials.

Every guy on the planet knows what's up. Nobody blames their workout equipment. Guys lift for X period of time and then that one week of slacking off turns into a month and it's over.

In my opinion, the very most misleading snake oil salesmen are are the vendors of "look young" cosmetic creams on television and the religious grifters who bring on testimonials from people who sent in "seed money" or paid for "anointed prayer cloths" and then had incredible financial windfalls shortly thereafter. Not sure how serious the FTC is about cracking down on questionable marketing techniques when they let the above mentioned imbeciles continue to run their ads. Just my opinion...
