Got Ripped Off on Odesk - Suggestions?

Hey Guys,

So I hired a contractor on Odesk for a straightforward content creation job. After providing everything to him I waited a week or so to see some progress. In response he said he would have something soon for me... and then he disappeared not a single reply after numerous messages and nearly 6 weeks later!

As it was a $300 job and he wanted 50% upfront I paid it without too much concern as he had only positive feedback.

I wanted to try to figure out if he was intentionally not responding or what the deal was. So I messaged him using the contact page of his personal website using a different name. Well in less than 24 hours I get a very detailed reply to my specific question, so it couldn't have been an auto-reply...

So in short he ripped myself and several others off (as he has several fixed contract contracts unfinished on there that I can see).

Just wondering what would you guys do knowing this? He's completely unresponsive via odesk and I want to try to have him face repercussions but unsure of what can be done.

I'm fine to let this all go as that seemed to be my only choice but if anyone knows of something I could do I'm all ears.

      Yes exactly! Give him a poor rating and a BUYER BEWARE review. This will put off his prospective buyers.

      I once had a problem where the person was to write me some articles, but her English was so poor I couldn't use them. I gave her a poor rating and she kept begging me to give her a fake 5 star review.
      I refused on the grounds that it would lead to more people having the same problem I had.

      Make sure you give him a poor rating. You owe it to anyone else that will consider using him in future.

        I completely agree. It is especially important to leave a Buyer Beware review because one or two bad ratings won't really affect their overall rating if they have done a lot of small projects. Plus, it could look like you are just a disgruntled client. A thorough Buyer Beware review is much more important and effective than just a low star rating.

        I can't believe that someone actually asked you to bump their rating. I have worked on Odesk for a couple of years and don't think that I have ever discussed ratings with a client.

        Another thing that just popped into my mind is a tip for buyers. Along with looking at the overall rating, take some time to go back and see how long they have been on Odesk. I would assume that if they have been working there for 6+ months (or a few years), then they would be less likely to cut and run during a project because they obviously rely on it more.

        Also keep an eye out for repeat clients when looking at the reviews. Providers who keep getting repeat clients are obviously doing something right.

    Ryan,
    Doesn't sound good. Your first action should be to raise a dispute via Odesk. However they may not help you recover the money. How did you deposit the funds? If via credit card then you should call your card company and explain that you used your card to pay for a service but haven't recieved it. They usually ask you to wait for 14-28 days before moving forward but I would chat to them now. If via another method then you may have extreme difficulty getting any of your money back TBH.

      Yes I left 1 star feedback and thoroughly explained the situation in the feedback I left so effectively his account is dead there now in terms of feedback, I made sure of that. Just annoying to see this guy got a whole bunch of contracts at once and then just ditched them all, I'm assuming he got money up front from others as well.

      I've been trying to figure out how to raise a dispute with Odesk, it really seems like they don't care to be a part of situations such as this. I would have used paypal which is directly linked to the account : (

      I'll see if there is anything I can do, thanks guys. I just sent him another message to his website, this time marked from myself and demanded the money back or face repercussions. So we'll see.

        Unfortunately Dispute Resolutions only apply to hourly contracts not flat rate on odesk. They really suck in that regard. However don't let this deter you from ever hiring flat rate again because flat rate is actually better. flat rate guarantees you don't get bled dry and that you get what you paid for. I think I only once paid a small upfront advance out of all the hires I've done on odesk. Never pay upfront even if you love the guy. There are lots of fish in the sea. Sorry to hear this happened to you. PM me and I will be happy to try and help you with your product creation.

    Yes raise a dispute with odesk for sure - and post feedback (Which I know does not help you right now). Just think if someone else had posted that feedback you would probably not have selected him.

    I don't use odesk much, but when I do I don't pay a deposit up front. was there a reason you did?

    Make a fuss and don't give up just yet - mention you are about to post negative feedback, etc if you don't hear from him, etc - You never know it might prompt him into action.

    I use odesk.com all the time and have never paid anyone upfront and there is no reason why I ever would.

    I would start a dispute with odesk and get the ball rolling in that sense. And you could also contact the others that are using this persons service and see if they have suffered in a similar way.

I told the contractor I had been supplied his physical address & if my money was not returned in full to me within 5 days a complaint of theft would be made to the nearest police station & to expect a visit from the police & any associated problems would be his. It was $200, & I also stated that I would actually have more pleasure in seeing him arrested than getting the money back & I would send a film crew to film it all for the entertainment value & publish it on a scam site where I could make more money off that, than on what he was working on for me. Told him - your choice. Next day money refunded.

      I also faced a similar issue with elance.com but I did not lose money. The contractor could not deliver the job on time sought extension twice but still could not complete. He offered me $100 adwords coupon and requested me not to give any negative remarks. Neither I accepted nor I gave any negative remark.

      Where I had almost lost money was with non-clickbank product which offered some auto pilot money with a money back guarantee. When I did not get any auto pilot money as promised by him, I asked for refund within the stipulated period but I received no response to any of my mails. I used the same trick of writing to him as a customer from a different mail id and got a fabulous reply. Then I knew he is out to scam people. I used the same threat (which you have posted here) and in less than 24 hrs I got a reply from him and in 48 hrs my money was also sent back.

    Sorry to hear you got bad experience on oDesk. But oDesk provide safety and protection to both parties.

    First: Did you create job on Hourly Basis or Fixed Basis?
    If you open job on Hourly Basis you have Team Room to review the Work Diary what he is doing? and you have review period after week to access and check everything is on track.

    You can also ask reports after week to keep everything on track. If the contractor is failed to provide insufficient reports you can open disputer and ask for refund money.

    If you open Fixed Job on oDesk which is not guaranteed payment for a contractor. Its not charged you hourly basis and even don't provide Work Diary Support. You can pay your contractor on Upfront, Milestones & Full Amount. Its totally depend on you how you can pay and receive work.

    I am working on oDesk from last 3 Years and never get ripped off by anyone. Just because I learn the system how it works.

    Better to check even there is 5 Star Feedback Profile. Never trust anyone, always compromise on performance.

    I am quite sorry of the experience that you went through.

    To begin with, the only reprieve that you can get is the feedback (which i presume that you have already left). When it comes to raising a dispute, there is no way that Odesk will entertain this as they get 10% of the cash (Quite sinister). It goes without saying that this in this scenario, the judge has a hand to play in the case.

    There is therefore no logical way that you can prove that you would like a refund of the money as it will be argued that you paid the money willingly.

    In my opinion, the only way that you can get some satisfaction out of this is through :

    a) Leave it go and hope that work karma catches up with this freelancer.

    b) Raise a complaint with complaints board or even the Ripoff report. Through this, Odesk might be arm-twisted to refund your money in exchange for you pulling off your complaint.

    If they did what you said, they're not going to give a rat's ass about an Odesk intervention.

    I would tell them two things (depending on where they're located):

    1. You're filling out paperwork in their county to file a small claims lawsuit. If you can see where he's located via his web whois, google the small claims for that area and link him to the PDF file they let you download and mail in.

    2. Tell him you'll be reporting him to the FBI's Internet Fraud Complaint Center (google it) and link him to it. Tell him that what he did was theft, and that that agency is reserved solely for those who rip others off online. So you'll be launching an investigation if your funds aren't recovered in 24 hours.

    Usually works just because they NEVER KNOW if you're going to do it and would prefer to have you off their back.

    I think issue a dispute with odesk and leave a -ve feedback...
    I support Tiffany's policy to great extent...That guy is just using his odesk id...to get money for free now...When no body will hire him anymore he will just throw it and create new one.

    Wow! Thanks guys, I never imagined I'd get so much support about this. I'm waiting to hear back from Odesk but I essentially told them what dsouravs suggested that he built this account to get some free cash.

    I'm shocked to see people who scoff at the idea of paying anything up front. The developer has just as much risk as you do. Paying an upfront fee shows you are serious and not wasting my time. I never do jobs without an upfront fee, unless I know the person.

      I require up front too whenever I do anything BUT it's certainly not "silly" for buyers to scoff at paying up front - they get ripped off too, as is evidenced in the OP.

      Even his deposit got ripped off. Both sides are vulnerable, which is why I would have liked Elance's escrow abilities back when I wrote there.

      Once you get burned EITHER as a provider or a client, you kind of scoff at putting yourself in harms way again. Natural reaction.

      Just hire people with a solid reputation and if necessary, turn into honey badger if you get bent over and screwed. Teaches them a lesson

        Like I said, developers risk just as much as buyers. Both have risk. If I do the job and the buyer is over bearing or decides not to pay for some reason I lose time and time is money. Of course I don't usually do jobs for a couple of hundred bucks, the jobs I do are a lot higher than that so the process between me and the buyer are more involved (face to face) than just going online and looking for the lowest bid.

        As the saying goes, you get what you pay for. A lot of people who dont know development think they should get the next facebook for under $500.

      For sure the solution to these types of problems is never pay upfront
      for any jobs. It works both ways. I've done work for clients who
      didn't pay the balance after the project was completed as well.

      So should I not deliver the completed project until I'm paid in full?

      The client trust me with the deposit and I trust him to pay the
      balance. The problem was not the process but simple dishonesty.

      You never do jobs without an upfront fee unless you know the person? Same thing applies to buyers, why should they pay you upfront?

      Hey if it's working for you good, but I've no doubt you are losing a lot of business with that policy - maybe it does not matter for you as you may have built a great reputation.

      But for the buyer in this thread what you are saying does not make sense - if he does not know the developer why would he risk paying up front?

    I made a HTML site and did everything for the client...but the client didnt paid me saying his pp is having probs...2 months passed..he didnt pay...he even didnt responds to me in skype...

    so i was lucky yes....i entered his ftp and deleted the files.....hahah
    and sold tht nice design to other client...

    I hate it when that happens. Unfortunately, there isn't a lot you can do beyond what you've already done. If he planned on getting a bunch of contracts and then ditching them then it is doubtful that he will care much about bad feedback.

    Definitely take the issue up with Odesk and make sure to mention that you plan on taking your business elsewhere if you don't come to an agreeable solution. Of course those words don't work unless you mean them!

    I do work through oDesk occasionally as a writer/spinner and I always ask for 25% upfront. I have been left hanging dry after creating content so yep it does swing both ways. I will say though it has only happened one time.

    The best thing that you could've done was come here and just distribute your experience for everybody else to obtain knowledge of what to do in this type of situation so for now I say forget about it and just never pay anybody upfront again. You need to build trust and reliability with a contractor before giving him such privileges as getting a upfront payment because the Internet workforce is a very shaky ship.

    Even if you do not pay people up front you will run into the fact that your extremely likely to get your time ripped off as there are many contractors that agreed to no upfront payment and when there are about 80% done tell you that they no longer wish to continue the project.

    You'll eventually realize why the following statement is a very, very common phrase.

    "Good help is hard to find"

    So when you find good help treat them like gold

    I do a bit of writing on ODesk and normally ask for a partial upfront payment, although most clients aren't a big fan of it. Here is the compromise that I have come up with and seems to make both sides happy.

    Instead of making a 50% up front payment, make a 50% milestone payment after 30%-50% of the work is done and pay the rest when the project is completed.

    This ensures the client is getting the work they ordered while also ensuring the provider that they are going to get paid.

    To be fair, I only do this for big projects. Anything that is 10 articles are less I just do the work and hope I get paid because it doesn't take more than a day to complete. Plus, if I don't get paid then I simply create a PLR package with the articles so I will get my money either way - or sell them to other clients in the same niche.

      Sorry to hear about your predicament. Hope you can resolve it as soon as possible. And teach that guy a good lesson because he is giving us content developers a bad name.

      My bread and butter is content development - sometimes on my own and sometimes with a team.

      Here is my long-winded POV, as a developer.

      I'll ask for upfront deposit only if a project requires a group of developers, sourcing new materials, getting research data and need time. And there were also projects when I asked for 100% payment ahead. There were simple jobs I did without asking for any payment until they are completed.

      It depends on the sort of jobs and also depends on how I perceive my clients. It is a matter of trust, that goes both ways. But trust doesn't happen instantly.

      So I have to be selective in order to reduce risks. Best thing is to know whom I'm dealing with, which must include physical contact address. Profile checks would be the most important first step. Reviews by others will support decision-making.

      Most of the time I got paid and despite all the controls, I still got ripped off ... lol . It's life !

      One was a refusal to pay a balance of US$25k for a training program development, despite a successful implementation and a written agreement. My remedy was easier than a legal one though, i.e. a threat to start a viral internet campaign against the enterprise. They saw my threat as very real as I've done an awesome traffic generation for them before. Instantly, the balance got paid 50% and the rest in a couple of lethargic installments ... lol. And the relationship is no longer cordial as before.

      If you're up to it, you can do the same. But first, weigh the use of your time, energy and resources - is it worth it?

    It's pretty widely acknowledged that quality control on odesk isn't the best. I do like 90% of my work through there, so I know it's a good system if you're shrewd about it, but you've really gotta be a bit cynical when you're negotiating jobs there. No matter how nice a person you are IRL, you must become the hard assed negotiator when working odesk. Just the way it is.

    Personally, I do not use odesk anymore. I use FIVerr now. It is a lot less expensive. For example, you can probably a gogi the same continent for about 30 bucks or slightly more. E-lance is yet another that I did not use. Fact is, I remember a lady can make you wait six months to deliver my content and what I got was $#@! Let that the lesson to you. FIverr is great on refunds and me getting my money.

    You can raise a dispute via paypal for this payment and they will refund it. I had exactly the same thing happen to me where the worker disappeared.

    Odesk help were less than helpful and refused to help / refund. I put a dispute through paypal and got a full refund.

    It's a shame when people do that on Odesk and it's a shame Odesk help aren't that helpful. It has put me off Odesk a lot.

    Good luck in getting your money back. Try something like iWriter or ContentAuthority maybe?

    I'm also working on oDesk since 6 months but I never demand any upfront payment because I think it's not necessary to demand anything regarding payment before completing the job. The Client & Contractor has to trust each other for a long relation. Its not just a single job that you can cheat someone & run away.
    In your case Ryan, you should have leave such a feedback on oDesk profile that the specified contractor should never get any job again. Also oDesk has to make some policies in this matter.

    support so they can give your money back if possible and ban that guy so he can't
    rip off more people.

    One of the reasons I like oDesk more than most other websites is because I have always had a good experience with the 100+ times I've hired someone to do jobs. I don't believe in the belief that I should partially pay someone for a partial shoddy product or service, it's all or nothing. If I hire someone and they agree to deliver a full working product and then they just contract the work to a lower less established person/company and get them to develop a poorer quality or offer a lower quality service, then I don't pay at all. I will pay if someone goes beyond the deadline, but I don't pay for half assed work. oDesk agree's with me on this. I never pay a penny for the work before hand. I feel they have looked every situation I have had. If you dispute it and you don't get your money back (which I have heard of happening unfortunately) - then dispute it with your merchant (Visa for example) or PayPal.

    Here's my experience...I decided to try out Elance and on my very first gig I got ripped off as a content provider. Did 20 articles, kept in touch the whole way, the person never indicated anything was wrong with my work and I never got paid.

    I learned then to not waste my time or talents on these kind of sites.

    And for those of you who think that contract providers never should ask for payment upfront, because we'll never get any work - Not true!

    Most of my content writing jobs are paid upfront. My clients never balk at that, either. A few times I have done work before getting paid, but that is a decision based on deciding if I can trust them. Have always gotten paid.

    Any newbies to contract work reading this should keep your options open. You are providing a professional service. For every potential client who doesn't want to pay upfront, there are many others who will. You'll have more peace of mind if you work for those clients.

    For those buying services, a few rotten apples does not mean that the majority of content providers are waiting to rip you off. Seek out the higher quality professionals. Ask questions before hiring. Look at porfolios, etc.

    There are better places than odesk to get
    your outsourcing done.

    Vworker.com is the best at protecting both
    buyer and seller.

    If your worker bails, you get the money back.

    The worker knows the buyer has the funds because
    its escrowed before the work starts.

    oDesk will do nothing to get your money back.

    Well I myself also do freelance on oDesk too. But I can afford to pick and choose my jobs unlike others that do freelance full-time. I did work for a VA on there and now she's a regular client that I fill in for when she's back logged or needs help in an area she doesn't have someone experienced in.

    But same as other freelancers here, I also will ask for a 25-50-25 percentage if I've never worked with you before. If I have worked with you then it is 10-80-10. Others might have different methods but this is my rules. All my jobs have been by the hour and have never had a problem.

    I'm also on Elance and vWorker (use to be Rent-A-Coder). Not the best place for anyone to hire people, but again I was on there when they first started.

    The best advice I can give is learn to evaluate freelancers a little more thoroughly. There is a process to this but if you're determined shouldn't be too hard to figure out a method. Naturally the more you use oDesk, or freelance sites, the better you'll perfect this method through your own experience.

    If anyone is interested in copywriting or articles, oDesk has another site with a little better content and writers. Now don't go there expecting to pay the prices I have seen from some people because better work comes at a better price. But the site is http://www.mediapiston.com/ if you're interested.

        This also another scammer, He rewarded me a project for a fixed amount of $350 and after completing the project he disappears. I got him from people per hour. He put an escrow deposit for that project around $100 but when PPH process the payment. they say they can't transfer it because its some kind of fraudulent. Well, as a consolation, they have may account paid for 3 months subscription from their site, but still, I don't think that was enough.


        I hope those scammers will die in a worst and horrible death.

    The nature of this business seems to be that we have to constantly deal with serial refunders, scammers and just outright liars. The unfortunate side effect of this is that we are all cast in a negative light. For your situation, you can:

    1) Pay via PayPal, file a dispute.
    2) Pay via CC, call your CC company and do a chargeback.

    I hope you get your money back. Good luck. To the guy who posted that information about people, you are violating this forum's rule #1, don't name names and start a war on this board.

    I truly thank you for your post and I feel very sorry for your lost. Raise as much fuss as you possibly can and at the end, forgive yourself. If you hold on to this loss it will prevent you from going forward with other things.

    I absolutely hate to lose like that-- and $300 is not a small change ... that looser loses more than you know -- he will be rip off by others 10 times that amount in the future.

    If I ever employ anybody on Odesk -- I will not pay nothing up front after this thread. So thank you again for your post.
